How is this a human rights issue? Nobody is forcing you (or me) to "waste" years.
Class action lawsuit - on what basis? I would like to be convinced otherwise, but USCIS is not doing anything against the laws.
it is a breach of expectations if nothing else. and the expectations are not unfounded. Also the per country quota limit irrespective of the number of applicants is something that is unjust. I am not a lawyer but there is something that is not right about the system - how it can be brought into a courtroom is something we can discuss and decide or a lawyer can help with.

Yes, you are required to send the FBI clearance along with your application. You do not need to get any police clearance from India.
I know a friend of mine who got his PR in 8 months. He was a Phd though. Mine took 2+ years as I was slow in answering their queries; I took my own sweet time - lol.
As explained earlier all you need to do is to send a fax explaining that your status changed for single to married to NYC Canadian Immigration Center. They will send you another application by mail with information on how to get your wife added to your application. You need to do the same thing for her; fill application, photo's, documentary evidence, FBI clearance etc,etc...
The above is valid even after approval (If you are in the one year transition period, they will extend this period until your wife gets her visa). The pitfall is you might have to wait a little longer to get your wife application straightened out.
If you already have a Canadian PR, you can sponsor a spouse visa and deal with the Immigration there on to get a PR for your wife… That’s a different route.

We do not like banning anyone and thats an extreme step which we are forced to under the curcumstances beyond our control.
Its possible that we did not intend to block anyone purposefully, but had to make a hard choice given the circumstances. If you could please share the information about the member who you suspect was banned unfairly, we will do further analysis and will get back to you soon.

Shouldn't we contact DOS/USCIS regarding this? And point out this error to them? How about a nice letter to DOS/USCIS with copies to AILA?
Ombudsman may be the best point to write on such issues. But the question is how does it impact you. Would those extra visas given to SK come to waiting people with India chargeability? Perhaps not, they would rather go to ROW candidates. An ROW candicate, therefore, would be more interested in demanding his/her rights.

With all the opposition that all the immigration bills are facing, I see little light for them. But how about we call the offices and request them just to end the 'country limit' on Employment based Green Card. Let the Employment Based Green Card be given thru a Fair system and that should be FIFO, when there is no quota on the number of people that enters the country for employment, it is unfair to have a Country Quota for Green Cards. If they can come up with a 5 Line Bill for this, this bill will have least opposition...

I feel 'people not donating' is not directly connected with money. For example lets aasume tomorrow USCIS opens up a premium service for 485 approval saying you pay $50,000 and your 485 processing will be completed within 6 months and this queue has unlimited visa numbers. Will people not pay 50K and get into that queue? I would say 50% of IV members would pay and make use of that.
The point is not about affordability.

Personally, I am not convinced by the 50% rejection logic. It is absurd that 1 out of 2 485s will be rejected after the 140 has been approved. If they are talking about concurrent cases where the 140 is not yet approved, it is absurd again that 1 out of 2 140s are not approved.
So either way, it does not sound right. If this number includes family cases too, then as EB rejection is lower than 50%, family rejection rate should be much higher than 50% for the combined rate to be 50%. That is not believable either.

your application must surely have been delivered, otherwise your so-called "lawyer" would have gotten it back by now. chances of USPS loosing it are very slim. most likely USCIS has it and has not processed it yet, like mine, and thousands of others.
do not send new application. wait another week or two and u will have ur receipt. think positive.
