ok, Since 12000 people are being part of the org now, I'm sure all the new members (including me) think that something is smoking! Here is the fresh news.

Senate has introduced a bill on immigration from their side called Comprehensive immigration Reform (CIR, you can see people sometimes refer as CIRcus in the forum, because too much is going on in this bill). The House has already come up with it's version of the bill STRIVE act 2007. So you can see info on that too. But let us concentrate on the CIR as it's harming us to the core than the benefits provided by STRIVE bill. Simple example is Extending your H1B is a ding dong bell! sounds funny or threatening!, yes if it's funny then your legal staus is on doll drums buddy! I am serious, not kidding, I swear!......
So this the main area you will find yourself coming often from now on.

I also received an RFE recently and it was for photos and copy of ID. I had sent these to USCIS after I e-filed, but it seems they lost it.

Hi,
I work with one desi company. Its actually a decent company, but they are refusing to give me experience letter. I have recently got a regular permanent postion with a different organization and the desi company are reluctant to let me go. Is there any way I can get the experience letter for my GC processing. I heard that an affidavit will work from an ex-employee but I was told that the best would be the experience letter from my employer. Is there a law that says that employer should provide experience letters when a employee quits?:(

My company financial position is good.
No Problems with My company end. Everyone telling me that this NOID is completely USCIS's mistake.
Attorney told me it wont be a problem because its USCIS mistake.
Attorney going for "Appeal" in my case.
Is there any problem if I choose Fulltime position with other company by using EAD in this situation?
Or I need to wait until I hear something from USCIS about this NOID??

- If a person is laid off after 140 approval + 485 pending for 180+ days, will there be any RFE or any other issues when he/she applies for EAD renewal on own?
- If a person is laid off after 140 approval + 485 pending for 180+ days, will there be an issues if travel is required outside the US and return back to US is by using AP? I mean to say, person is unemployed (140 approval + 485 pending for 180+ days, has valid EAD/AP in hand) and needs to travel outside the US.

It seems WAC are a rare lot and must be comprising many who are not approved yet...there may be a pattern to it...
So you ask not to rake up FP for me....that i won't ....but my wife being not approved is it good to ask what's holding her approval....
I read in the forum that some EAC cases were not approved as biometrics were not uploaded and the IO set the ball rolling and they got approvals soon...
I don't want her to miss the bus for some bureaucratic fallacy...and miss the bus again this year...

Very true ... GC/ Citizenship is a privielage not a right, unless you are born in USA. Let's stop ranting about how highly qualified one is and how miserable your career had been, just beacuse of you not having GC. This is simply an excuse to ones own failures and blaiming others. I filed my eEAD 45 days back, competed finger printing 15 days back, still I don't see LUD on my case; However, my spouse who filed 30 days back had 3 LUD, and a recent after finger print.
Can guys suggest, is this common. Usually after FP I should see a LUD, right? What are my options..:confused:

Only realistic option you have is to wait out your 90 days and take an Infopass oppointment if you dont get your EAD by then.

Hi Guys, If any one else faced a similar situation.
My wife gave her road test on April 04/05/08 and passed the test but DMV failed to issue her driving license as they could not find her I94 in list provided by USCIS for clearance for issuance of Driving License and the officer who took her road test explained to us that they sent the query to USCIS and asked us come back in 15 days, and when we went there for the second time a different office but same story and this is going on since then, I called USCIS today ( the number provided by DMV for USCIS ) to ask them if they have my wife's ending application for clearence they say that don't interfere into driving license issues and we have deal with state of Georgia.
DMV office is not accepting any phone calls to update us with he status of the query, so we have go there wait for 2 hours and get the same response back.
My wife is currently on H1 valid until Oct 2010.

A reputed local channel is producing a documentary on the contributions of the immigrants to the economy and the difficulties they have to face and have to overcome to survive here and Highly Skilled Legal Immigrant group will be one of the three groups they will be focusing on. Pdakwala one of the co founders of IV has been working with the channel to make sure that there is coverage of the challenges we the Highly Skilled Legal Immigrants are facing due to the present outdated immigration process.
My wife and me both Highly Skilled Legal Immigrants will be a part of this documentary. What I intend to do is ....to send a detailed document to the producers mentioning three points so that they have a clear understanding of the contributions we make and the issues we are facing
1. The economic and cultural contributions the HSLI's make.
2. The Competitive advantage this country will lose if it does not make immediate amendments to the broken Immigration process.
3. Debunk some myths such as H1's dont pay tax, H1's take away jobs etc

Hi All,
My previous employer just called me and informed about revoking I-140. I have been working for a new employer for the past one year and did not invoke AC21 .
Would there be any complications in invoking AC21 now, where as it should have been done last year ?

This is my first post. I am PhD student majoring in Math..........If this bill passes it will be a boon for all international PhDs. But congressman Flake proposed this in 2008 and it died very soon. I hope it will gain some momentum this time atleast. Is it possible to send a supporting letter from many international PhD students to publicize it?

It is employer's choice and decision whether to file labor or not. Employee does not have any say or input on this.
Having said that if employer claims that labor was filed for you as beneficiary, you can request for case#. It is upto the employer if they want to share case# with the employee or not.
As a practical matter, employer should be willing such information with employee. Again, thats on the moral/ethical ground, not on legal ground.
