Technically once you filed I-140 then the labor has no value and you have to take action based on I-140. The rule is you can extend your H1B based on your pending labor or pending I-140 or approved I-140. That means once you file I-140 then do not hold your breath to file an H1B extension based on your labor.

Even if the current 140 is delayed/denied(God forbid) for any reason, he can always file for another fresh 140 on the same labor. The labor does not get cancelled as long as the first 140 was filed within 180 days of the approval of labor.
Robert, unless the 140 had a issue with some educational req in labor that you do not meet, you will be able to keep your same PD, even in the worst case scenario of filing for a fresh 140.

Hello All,
I have read that it is not advisable to take any public assistance (like file for Unemployment) while on EAD.
I am a August 2007 filer with I140 approved and 485 filed > 180 days. I was recently laid off and I am planning to take COBRA for my health insurance needs. I have got some paperwork regarding ARRA Premium Reduction (American Recovery and Reinvestment Act) where it says if your job is involuntarily terminated you can get 65% payments for your COBRA payment from ARRA Premium Reduction program.
My questions for the experts is, is it advisable to take this assistance? Can it cause a RFE on my 485?

Regarding (6) above, it is not 10K, more like 5K.
Only a part of AC21 is repealed; ppl can still move one year after their 140 is approved and 485 is pending.

I was reading the USA Today articles and I have a suggestion...guys please try to do spell check before you submit to such forums. It looks bad on us especially when we call ourselves skilled immigrants.
One glaring error that I saw was this guy with a MBA from Stanford Univ and he wrote it as "Standford Univ"......Is there a univ called "Standford"???? I tried googling it but did not find it...I hope it was not somebody from our group....
It could be key board of the computer not working right .. ;)
I will not worry too much about it . .. For those who do not have lot time to check spellings, I would suggest to put a disclaimer on the top, "you may encounter spell mistakes due to key boadd not functioning right." :D

I would like to find out if anybody here heard of H1B denial due to lack of MASTERS DEGREE IN PHYSICAL THERAPY.

This has been bugging me for a while now. I applied for I-485 in July 2007.
I do not have copies of all H1 approval notices ever issued. I do not have all of my I-94s ever issued.
Per attorney's recommendation, I applied for duplicate copies of I-797 but that will take a few months.
I am wondering what I can do if USCIS asks for all I-797s and I-94s since first ever entry to prove that I have always been in the US legally.
Any thoughts.
Don't want to waste anyone's time. If anyone has been in this situation or knows of anyone that was in a situation like this..that would help.
I want to be proactive and get other documents ready if that is what it'll take.

Have you or someone you khow actually been able to get a copy of I-140 using G-639? If so when was that and what was the processing time?
The reason I ask is because I have heard all kinds of stories about using FOIA to get a copy of I-140.

My wife had gone to DMV in fair oaks mall and they had asked her to produce the original I485 and unfortunately we don't carry it. Our license is going to expire next month.

Should we lobby Cornyn to break this into two amendments.. one for unused visas.. and other for increasing the number of H1's. I think we have lost out on many occasions because of H1 increase request. I am sure proponents of H1 increase by this time will understand this request.
given CIR's debacle, anything increasing visa quota is a dead end. Nobody will touch it. I'm not saying it is a good idea, but it will guarantee a failure.
I suggest sticking to 'technical correction', stuff nobody cares about. Recapturing unused visas can be sold as just doing what congress mandated but bureaucrats were unable to pull off. The US public has no problem bitching about incompetent government agencies.
It is a different thing to convince everyone to let in even more immigrants that there already are.
Forget the H1-B quota increase, nobody will touch it.
Technical corrects may still be possible. Keep the debate as technical as you can. No emotions erupt from technical debates. People will react like 'who cares - I don't understand what you are talking about'

hey seattle, I have not heard of part time worker + FT student on H1 either....as far as getting 140 from F1...I just don't see how that is possible? 140+ 485 ia all employment based....if they see that you no longer have a job...then wouldn't that immediately disqualify you? Anyways - I'm pretty sure that I do not want to switch to F1....even if I were willing to give up my place in the longest darn line in the world, I need money coming in while I am at school!!

If you feel so passionately about it, here's what I suggest. Create a blog/website and every single day after his program, post an article pointing out factual inaccuracies in Lou's reports and views. If you don't want to watch the program, then CNN publishes a transcript a couple of hours later - follow that.
It's hard work but believe me - do it consistently and do it well and you will see that it will work.
Best of luck and post the address of your site/blog here should you decide to do it.

Emergency AP can be obtained from the local office with scanned letter.
It should not be a problem. Only the color paper they use is different than the one sent by the service center....

I have an infopass appointment for tomorrow. Are the infopass officers qualified to review the file and process it right away?
Nope infopass officers are not at all helpful. I found out that many are just
"half-trained" customer service reps who have access to whatever online
system USCIS uses. They can tell you if your background checks were cleared,
what your priority date is (if you have multiple I-140s) and if every thing
has been bundled together in your "A-file" or not.
I had a horrible infopass where the "officer" didnt even know what a I-140 was.
Try sending a clear letter to the ombudsman right away. Be very clear an give copies
of everything you have I-485 receipts, your PD, country of chargeability etc etc.
I did send a letter to the ombudsman in mid dec got a usual we have opened a
request with USCIS and you will get answer in 45 days 2 weeks ago. Last week
got a phone call - yes a phone call - from them last week saying they got a email from USCIS saying my case is being fowarded for adjudication and you will get a result within 30 days.

My wife's F-1 stamping visa got rejected (IInd time)in India, though she had H-4 to F-1 approved here in US by USCIS.
We really want the OPT option that F-1 gives.
Once she is back to US on H-4, is there any way that we can get the OPT since she has been maintaining her full time intl. status?
Can we do a lawyer since the embassy is "wrong" in denying the visa since USCIS already approved it and she has only one sem. remaining.
We are very worried. Please help.

If you read the post , they say 21 year old means fresh graduate (bach.), it is very high for that age with no or less experience. here in california also freshers get 50-60k start..
