Hi- I had my H1-B VISA Revalidation done at Ottawa, Canada on 03/18/2008
It really went very well, no issues, They asked few questions like whom do you work? and who is your employer.
Please make sure you take the following.
1: Employer Letter
2: If possible Client Letter. (In my case they asked me)
3: 6 months pay stub
4: All W2s, Tax Returns
Mine is 7th year extension.

If lawyer is involved in the recruitment process, its illegal and your PERM become invalid. Yes, as others pointed out if there are any qualified candidates the company should take them and let you go. Thats the law.
There is no law that the employer has to lay-off/let go the PERM candidate and hire the qualified applicant. However, if a qualified applicant is found and he/she is willing to accept employment as per the requirements, then the law is that the PERM process cannot be continued at that point, meaning PERM cannot be filed.

Planning to go to Canada for two days. Apart from this, is there any additional document required like offer letter, salary slip? The Automatic Visa Revalidation rule mentions only these

I have gone through a similar situation, where when you (h1B applicant) move to a new company, along with your transfer request or immediately upon the transfer approval, you will need to file an application for your H4 dependent which is available on USCIS website ($ 250) and request a transfer. One good thing about this is you can do it within USA.
I am 100% sure on this, period!

H4 status is not linked to any employer. I suggest that you talk to attorney and confirm for yourself.

To judge the immigration credential, it will be good to take a look at candidate's websites and check Issues -> Immigration section.
Obama supports increase in visa number for legal immigrants. Hillary does not say anything about it. She does oppose guest worker program which allegedly exploits American worker by undermining their wages. Have not we heard it before from anti-immigrant lobby.
There was another article on CNN blog ticker sometime back which mentions:
"but the details of the study suggest the Clinton and Obama's voting records are not as far apart as they appear in the rankings. Of the 65 votes included in the study that both senators were present for, they only differed twice — on a measure that sought to establish an Office of Public Integrity to handle ethics complaints (Clinton voted no, Obama yes), and on a measure that sought to allow certain immigrants to stay in the united states while renewing their visas (again, Clinton voted no and Obama yes).
I think Obama is better in terms of pro-immigration reforms.
On Republican side, both McCain and Huckabee are sympathetic. Huckabee has more clear agenda on this. As per his website:

I applied H1b for my wife when she is in India, now she came to usa on H4, She has I94 of H4 and she cant apply for SSN using H4 194. If she needs to apply for SSN she needs to go back to India / Outside the USA and come back on H1b Stamping where she get I-94 for H1b Status. But instead of doing that now she got her EAD, can she do the any of the below so that the EAD will not come into play and where she can still use her H1b and as you all Using EAD until 485 gets approve is not suggestable....Thank You..

Why would the security take out all your documents? is it because you had it in a bag/plastic bag? Can we put them in transparent folders and carry 10 folders instead of carrying them in a bag? will they still take out everything and disorganize what you have carefully put together? Hey my wife might go alone for the interview and it would be helpful if you provide some information.

Its been a long time since I did it and dont really remember it correctly.
I did not have the docs in a bag or a plastic bag. I had carried them in a documents file bought at staples. Yes I did put all the documents into clear transparent folders and had them logically placed into documents file. The security person did take out everything....trust me each and every document out of the file and out of the documents folder. They even take out any documents in the envelopes and check them and then stamp the envelope. The most ridiculous part is that the security scanner used at the airports sits idle next to the line you are standing....and you would be wondering what it does. This happened to my brother who visited the embassy in DEC and he did warn me...but I thought he was little bit exaggreting...but did not realize he was telling the truth.
I went through the following steps...
1) Outside the embassy, even before u enter the premisis of the embassy, the security guy would check for your VISA appointment letter, PASSPORT and the HDFC receipt.
2) Once past the above step, security would check using the hand scanner.
3) At this point you enter the premisis of the embassy and thats where the secuirty makes merry with your documents and you walk through a metal detector
4) You stand in the line where they check your documents like 797 Passport, I 129 and place them in a file.
5) You might be redirected to another building where the interview would take place and this is what has happened for most of the people.
6) But when I had been for the interview on May 4th they sent to me a different counter in the same building, very next to the one where the documents were checked and was interviewed. I did not even realize that I was being interviewed since I was expecting to go the other building for interview. I think I was lucky enough to get the interview at the same counter, but some people were being directed to the other building for interviews....
The security check for female/women are little more cordial. This is based on my wife's experience.

There has been a lot of cases on the H1B transfer denial.
I would suggest everyone to stick to the place where they are.. A few $$ less is better than loosing the piece of mind. Or Use EAD.
Wait till the end of this year atleast, I am pretty sure the things will get better with the bill on immigration gets passed.

I am a July 2007 filer joined new company(1000+ employees) in Jan 2009 & applied for H1 transfer. H1 with old company is valid till January 2010.
Now my H1 transfer is denied. I am 99% sure my company will not file MTR. It looks like it is their corporate policy. Most probably i will not even know the reason why it was denied. (again corporate policy).
I need your valuable suggestion. What are my options here?
1) Can i go back to original company if possible?
2) Can i be able to do an H1 transfer if I find some other company? Will it be approved considering that MTR is not filed for current applicaiton.
3) If I can file for H1 transfer with other company how much time i have to do it.

Well, in my case,
I do have that letter now, its just that the company lawyer was not providing it to my new lawyer at the time of filing becoz he was very busy.
Anyway, even if in worst case if they reject the I-485, for not having that letter, can i reopen the case and submit the employer letter later?

I have been experiencing weird things on my long time back approved I-140. Last month I got HLUD that the case has been transfered to TSC as they've jurisdiction over it. 3 days later it changed to saying Acknowledgement notice has been sent for withdrawl of petition. Then a 2 week ago had LUD on my 485. 4 days after that spouse got RFE for medicals. And today just now another HLUD on 140 saying :

Current Status: Response to request for evidence received, and case processing has resumed.
On September 9, 2009, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. The USCIS clinic I had been to does not have chicken pox vaccine and are not sure when they will get one. The Dr. said that they cant do anything about it and can write on the form that no vaccination was available. But she was not sure how USCIS would decide on this comment. Has anyone run into similar situation? What are my options in this scenario?

Do the letters have to be from ppl from my previous company?
cant it be from ppl who have left the company!..both my managers have quit the firm ..and started their own firms..
and no one who works there was my manager...the HR is acting nuts..
