I just now called TSC and spoke to IO, nice lady, here is what happened:
I: Wanted to know my status as my PD ( Oct'01 - EB3 - India) is current and RD is also current ( Though I know its going to be current by May 1st)
IO ( Nice Lady): Its pending, thats what I can tell you right now,
I: My RD and PD both are current, is there any thing else you can tell me.
IO: All the cases for 2001 & 2002 are pending for adjudication, and your is one among them. Officers will be making decision on these cases with in 30-90 days. Your case is not yet assigned to any officer. If you want, I can send an email to Officer to look into your file.
I: Is there anything else you can tell me
IO: Thats all I can help you with today.

Hey there,
I'm going through all that right now. I went to the Driver's License place last Wednesday and it was a pretty bad experience.
My license expires on 10/6 and my EAD on 11/5. But I already received my new EAD that expires on Nov 2012, so I was hoping that they would give me a new license good until Nov 2012 instead of 11/5/10.
So I hand both EAD cards to the woman behind the counter and she tells me they can't use the newer card because it's doesn't start until 11/5, which is ridiculous... so she tells me that I have to use my current, soon to expire EAD and then they will give me a license valid til 11/5. Then I would have to go and renew again using my new EAD. SO annoying. So she tells me to sit down that they are running my name on the computer. After a while she leaves the counter and tells me some other woman will call my name shortly.
After 20 minutes, this new lady calls my name and I have to go through the whole explanation again, and she ends up telling me that I should wait til 11/5 to renew my license. So I ask her, what am I supposed to do between 10/6 (my license exp date) and 11/5? She tells me she doesn't know, to just wait! I ask her if I"m supposed to be driving ilegally to go to work and she tells me she's not saying that I should drive. At that point I'm very upset and I tell her that there must be someone in that building that would know what to do with my case and she says she's the manager!!! Then she says that if she enters my new EAD on the System, that it would be rejected and that I would have to wait 30 days to try to reapply (???). So I told her to run my current EAD instead and she told me the system couldn't validate it either (ARGH!). Obviously, she wouldnt know (or tell me) why neither EAD cards would verify on the computer and gave me a SAVE paper telling me to come back and check again in a week.
So in a couple of days I'll be going back and see how it all continues.
VERY FRUSTRATING.

Situation: I have to sublet my apartment for a few months and will have to transfer the lease on the subletters' names, which means they will have their names on the mailbox for few months. After that, the lease will be on my name again. I am worried that in case if I get any USCIS mail/document, it may not get delivered if my name will not be on the mailbox.
Concern: I am hesitant to fill out the AR 11/address change form since I will have to do it again in a few months when I return; they haven't been found to be reliable (several members have posted related experiences, the most recent being:http://immigrationvoice.org/forum/showthread.php?t=16242

Since your W2 shows wages less than the prevailing wage and the compony is showing loss, the only other option to explore is look at the companies net assets. You can find this number from the companies tax returns. Your lawyer should be able to access this and if the net assets are greater than or equal to the difference between the actual and proffered wage, then you should be ok.
I am quite certain that my company has negative net assets. Some colleagues close to HR told me that my company might be in debt. This is just hopeless for me now. I have to accept my fate and move on. Maybe I am not destined to stay in the US after all.

I filed WoM in December, 2006. NC was pending since April, 2004 (waited for a PD (May, 2002) to become current before filing Wom, but now I believe I did not have to wait for PD to become current). I think without Wom I'd still be waiting (I-485 was filed in March, 2004).
It's not necessary to wait 2 years to file Wom.
I know one need not wait for 2 years but i beleive one has to exhaust all other options to expedite the NC before filing WOM.

Appu, can't you ask your HR to process the H1B extension with premium processing ? with premium process your H1b should be approved at least in 2 weeks.
I did my extension at the very last minute too, my H1b expired on Feb24 and my lawyer and I just finished all the paperwork and submit the extension online on Feb16. Got the receipt the same day and the case was approved on Feb22

I personally wish EB3-ROWers were more active in this forum, so I'm going to start the ball rolling. Of course, I'm not a professional and my opinions are not law. Take them with a grain of salt. However, this is what I think about your situation:
My prediction for your Oct 2005 PD case: you will get GC within the '09 working year. Here are my opinions and my reasonings:
1. Your lawyer is crap; Fire him.
You were current before this year ended. In June this year, the cutoff was 03/06. Your lawyer should have been working his ass off, making calls and contacting AILA and doing everything he could to get you your GC then. You missed your chance. YOU MISSED YOUR CHANCE.
2. Whether the EB2-ROW spillover goes to EB2-I or EB3-ROW - all this is irrelevant for your case right now. You only care about it if in Jun 09, the cutoff date hasn't reached Oct 05 (highly unlikely).
Just saying quoting "Spillover to EB2-I! You wait long!" is the lazy man's careless opinion.
I personally feel USCIS didn't know what to do with the '08 EB2-ROW spillover, and just allocated it to EB2-I. If EB2-ROW spillovers to EB2-I were permanently the new trend, EB2-I would not retrogress back more than 3 years. For your comparison, EB3-ROW retrogressed 1 year 2 months.

One other process that is almost as frustrating (if not more) as the GC process is the unpredictability of the visitor visas at consulates.
My parents have made multiple 'pilgrimages' to the Chennai US consulate for a visitor visa and are yet to get an approval. This has turned into an annual ritual for them.
Well, not having any of their children based in India seems be working against them. But, can't they come up with a better system to ensure visitors return before their visa expires (maybe track it against the sponsor's H1), rather that merely rejecting visitor visas based on the whims of the consular officer?
Does anyone have any pointers to share that may help?

Personally I would not advise taking this advice as legally it is fraudulent and could jeopardise your petition. The safest route is to have another employee give you a notarized letter. Alternatively if you worked as a consultant, your client could give you the experience letter.
The normal practice is, take a letterhead from the company and then get your collegue or manager to sign it. Believe me, 100% people do that. If you have offer letters etc... from your company, scan the letter and use photoshop to create a letterhead and write your own stuff, if for some reason your collegues are scared to sign any document (which happened in my case), get it from someone who was working in that company and left the company. If that also does not work out, just get a friend to sign it.
The reference letter need not actually be on the company letterhead, your friend can use his present company letterhead or the letter need not be on the letterhead, it can be on a regular paper that is notarized.

My daughter got the stamped passport back from Hyderabad consulate.
I tried looking for the prerequisite courses also, but it takes atleast 3 yeasr to complete all those courses here. That is the reason I preferred her to join in India from the beginning of the course.
Basically visa stamping gave us 3 years of waiting period for GC. If we dont get greencard in these 3 years then I will have to apply for advance parole for 1 year when she comes here for vacation and that compeltes her studies in India and she can come back to US and continue.
Thanks for all responses and right now I am checking with attorney to see if I keep on applying for her parole every year when she comes here for vacation or should I just do it after 3 years prior to the expiry of H4 stamping...Any ideas please....
