Found the old J1 Visa stamped in the passport. It does list the 212(e) requirement.
At the time when I got the first H1, I had 2 years, or close to 2 years of accrued stay in Russia. I should definitely have 2 years by now.
What could be the result of not having had full 2 years at the time of first H1? What could be the effect on the currently active H1?
If I show that right now I have 2 full years, would the AOS proceed, or are there any retroactive problems?

Gurus, please help. Can anybody throw some light on why my LUD has changed on I-485. Could it be because of name clearance.
Name check cleared would not result in a lud. But if you get more luds in the next couple of days, which probebly means they are processing your case, you can say your name check is cleared, because they only start process your case after name check is cleared.
Is you PD current? If not, your case cann't be approved no matter how many luds.

Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.

Good to see motivated members.....
It is certain that the politicians will not touch the immigration topic in the next one year. Even after best efforts of the president the immigration bill failed in the senate few months ago.
One and only one thing that can be tried before Nov 2008 is the recapture of visa numbers from the last five years. I think IV should push for that.
Other than the above not much can happen, get ready for really long cold winter and then a looong hot summer. I wish things were better.

Hi,
I applied on July2nd, I got the receipts on september7th and FP for oct23rd but no EAD yet! I have seen most of them get EAD but no FP, Does it matter which comes first should I wait sometime after FP for EAD?

Yes he can apply for a TN again, no limit on the number of times alien can enter on TN. If he leaves while his COS is pending it will be considered to be abandonment of the petition.

Pineapple, although I dont have a solution to your problem I can definitely say that something is better than nothing. The senate dont have a problem with legal immigration, as long it is legal. If we can get our EB provisions as a part of this bill, most of them will be happy. There will quirks that can apply to immigrants as well, but that has to be addresed by the part of overall nature of the bill.

Hi Everyone,
I need help urgently , my port of entry is SFO and on the I94 I have not written my complete name as I didn't understand the the importance of I-94 . When I tried to apply for SSN i was told that the names has to match with the name written in I-94 at the port of entry and the person said that I have no other option to change the name so I agreed upon the name which on SSN . Now I googled out and came to know that I can change the name in port of entry . It would be of great help for me if any one can help me out getting out of this situation .

Hey,
I was in the same situation like you are now and I wrote a detailed letter with all paper work, 2 color photographs and also the FP notice and explained the situation. I was lucky to see a LUD the day they received the paper work and in 2 days mine was approved and its on its way now.
Hope this helps. I understand this might not be the case for all but it worked for me.

My employer filled EB-2 PERM for me on 12/2007.
My I-140 is approved on 07/2008.
Now I am worry about losing my job.
If this happens, maybe I will switch to NIW pathway later.
Now I wonder whether NIW can use the PD of PERM?
My attorney is not sure about this.

My Employer applied for Labor on Aug 11th 2010 and yesterday we got the audit notice saying :
The application indicates the foreign worker is required to live on employer's premises although the application does not indicate the position is for a Live-in domestic. Please provide a detailed explanation indicating the reason the foreign worker must reside with the employer.
In ETA-9089 for Section H-17 question we have checked "Yes" but i guess it should be No.
We miss understood the question and thought it was asking about working at location and maked it yes.
my question is :
1) Can we make correction and send while replying to Audit (RFE)?
Please help on this.
