Hi yvsatyaprasad,
Thanks for your reply. Would you please clarify one thing for me ? Did you stay in the US beyond your AP based I-94 date and then was able to exit US and come back with new AP?
Kuhelica-
Your wife should be fine, I traveled on an expired I-94 with valid Advance Parole and the immigration officer did not ask me any questions.
Hope this helps

Thanks dreamcumtrue. You post is indeed a positive one. As you have said that your receipt number remained the same, were you able to track the application online using this number. I mean did it change its status as the reapplication was processed - from Pending to Approved or it stayed approved all along.
Actually I checked the status online only after I received my new EAD card since I received the card very quick which I didn't expect. The status says 'On July 8, 2009, we mailed the new card directly to the address we have on file...'

Wow! I didn't know that you got to take 2 sets of finger prints for EAD and I-485. I didn't got finger print notice for I-485, but got notices for EAD. When do they usually send finger prints for I-485?
Well, I lied. I did got finger print notices and, indeed, finished them last year. Too much stress I guess.

To be honest this a very vague area of the law. I have seen people switch to unrelated job getting GC's without any issues and also know of one who did everything by the book getting an RFE. Just talk to your lawyer and stick to what he says, we end up over analyzing issues and miss the bus. I say this because i have done everything by the book so far and am still waiting. I hear that they are getting more particular about AC21 these days. Do what you think is best for you and once you take a decision just go ahead.
Well things have been fine but now things are changing. You can see people getting RFE on employment even if he/she does an AR11 address change.
AC21 RFEs are now very specific with job requirement, experience, education.
Looks like the original poster's job MAY be similar but it is better to check with an experienced Attorney

Thank You..
This is the fist time I am hearing that a lawyer is refusing to provide the information of 140 to sponsering employer. This is ridiculous. I-140 is employer's property and lawyer is working for employer. I guess, there is something else that you might not aware of. You should try to have a conf call between u , lawyer and employer and find out where is the issue.
I am sure, the employer has some issues with the previous legal, but the employer is not willing to share or talk about. Whenever I bring up the point of contacting the previous legal, they don't seem to like it.
The previous legal was hired and paid by the employer, Is there a way for me to contact the previous legal?.

I am not currently in Boston, but spend a lot of years there...great idea guys,
just something to think over
Wouldn't it be cool to have the rally along the freedom trail... start and end at state street...one of the meeting points could be where there was the Boston "massacre"

in addition to the same-similar requirement of the new job, it also needs to be a 'permanent' one. I am not sure if this temporary/contract job will qualify for that. Check with an attorney before you take up this offer.
Doing it on the side part-time using your EAD while you are working for someone else fulltime should be ok in this regard. Having only this contract position can be potentially troublesome...
Here is what AC21 law says
__________________________________________________ ________________________
(j) JOB FLEXIBILITY FOR LONG DELAYED APPLICANTS FOR ADJUSTMENT OF STATUS TO PERMANENT RESIDENCE- A petition under subsection (a)(1)(D)for an individual whose application for adjustment of status pursuant to section 245 has been filed and remained unadjudicated for 180 days or more shall remain valid with respect to a new job if the individual changes jobs or employers if the new job is in the same or a similar occupational classification as the job for which the petition was filed..
(2) Section 212(a)(5)(A) of the Immigration and Nationality Act (8 U.S.C. 1182(a)(5)(A))is amended by adding at the end the following new clause:
(iv) LONG DELAYED ADJUSTMENT APPLICANTS- A certification made under clause (i) with respect to an individual whose petition is covered by section 204(j) shall remain valid with respect to a new job accepted by the individual after the individual changes jobs or employers if the new job is in the same or a similar occupational classification as the job for which the certification was issued..
__________________________________________________ ________________________
I am not trying to contradict you. It does not say anything about permanent job or contract job. There are different ways of interpreting this law.
Can anyone shed some light on the permanent and temporary job classifications along with the legality pertaining to AC21?

I appreciate we are all in queue to have that resident card. Most, if not all amongst us have been fortunate to have an education, travel, find work and a livelihood here in America. However, there are the less fortunate who may not have the opportunities (or the possibilities) The Diversity Lottery program extends that possibility to those less fortunate, restricted in their lives for whatever reason and so on. Giving people an opportunity so they too can have a better future is (one of the) beauty of this land. This also brings more diversity to the land, where people of different backgrouds / origins come together. Personally, I find it all quite fascinating, because I grew up in a multicultural town, where people hardly integrated. Everybody formed their own little towns. Anyway, I for one, do not support the removal of this program in its entirety, because I do not believe someone with a Masters (I have one) or a PhD education, should have more privileges (in addition to what's on hand) to folks who may not have any? Anyway, its just an opinion.
Ryan,
What good is the 50000 figure going to do in the name of "diversity"? We are already flooded with 12 M of people from outside, and any exercise of diversity is a laughing stock at the face of this. OTOH, having 140000 people who can integrate well into American society and who have been waiting for years is only a common-sense solution. Perhaps, the diversity visas can come back once the matters of illegal immigration and visa backlogs have been dealt with?

Legally, how much time is allowed to get the new H1B employer.
Let us say your employer said today that tomorrow is your last day. Sometimes these do happen in these bad times.
So how much time is allowed to find the next one, on H1B-transfer.
Do you have an ead?

Get another attorney. Your attorney obviously doesn't know the basics of EB or is trying to get you in EB3 so he can keep extracting fees from you for years to come. Given that yr Vietnamese, if you file in EB2 you will get a GC in months. After that he can't take any more fees from you.
Filing in EB2 or EB3 depends on the job requirement and not the candidate. If the job requires a Masters Degree or bachelors+4 years experience, then EB2 can be filed. Whether that experience is US or otherwise is irrelevant. Besides, if you have been working in NJ for 3 years, how is that not US experience? Is your experience is determined by the race/nationality of the people who own the company or the
the place where you were working?
My company filed for my EB2 successfully when I had around 3 yrs experience. The job required a Masters degree, and that's why they filed in EB2.
Wrong. Your current experience with the GC sponsoring employer is not counted for the GC propose. So the three years experience can not be used.

I just went through the Murthy Dot Com and realized that to whom this motivation aimed at? As Logiclife mentioned, so many people delayed filing 485 to accomplish THE MUST TO DO things.
My comments are, why somebody wants to immigrate to another country? When you see good prospectus in life. So, in the best times of your life (age between 26 to 40) when you have plenty of energy, ideas, to do lot of things, this kind of pushing into UNKNOWN ZONE of waiting forever confuses and wastes the precious time. That is so stressful and not good for the country and individual either.

I have EB2 with PD = OCT-2006. We have EAD and I-485 is in process. I-140 is approved in MAR-2007. I have not yet used my EAD and with the current employer working as consultant who filed my GC.
What are my options if I lose my job now? Should I use EAD to find the job before I lose (There are some chances on terminating project)? What is the best case scenario if I don't want to change my employer? I don't get pay if I don't have work. Please help me.
Thanks in advance.
As your 140 is approved and 485 is pending more than 180 days, you are safe to change jobs now, but you must work in a same or similar job for your 485 adjudication.
You can chose to use your EAD or get a new h1b transfer - it is your choice.
