I received RFE e-mail today morning from NSC ,but wont know the nature of RFE until I receive the letter from USCIS.
Ours is the EAD online renewal filed on July 02nd 2008. RFE is only for my application, nothing yet for my wife's EAD application.
I am surprised your PD is current and why USCIS is requesting evidence for the EAD? instead they should process your I-485 and be done with it.
anyways USCIS processing has no logic sometimes, or may be the EAD department dont know whats happening is adjustment of status department.
Please share the RFE details with IVans once you receive the letter. Hope it is as simaple as photo ID or missing signature etc. I was trying to google EAD RFE information ,but couldnt find much except for the simple requests like address, Photo, missing signature etc.

My PD is Jan04 for EB3 India and its severely retrogressed. I wasn't available for EB2 filing at that time.
Now my current employer can not file my GC in EB2 and use the same Priority date as all the experience is in the current company.
Now if I change employers and new employer files my GC in EB2, can my same priority date be used for the new GC? My I140 is approved and I485 was filed in July 07.
Can there be any problems if I go this route, can my current employer revoke my I140 before my I140 is filed for new EB2 GC? Or is it a safe bet to go this route and get GC faster because if my same PD is kept in EB2 it will be current as soon as I140 is filed.
Please let me know your opinion.

This is a real GEM of a post Raj. Thank You.
I am listing out what exactly, I have done and my EB3 GC is still active without any trouble. My current employer filed for GC and they are about to file my I-140 in EB2 porting my EB3 PD.
1. Get a legible copy of your current labor certification.
2. Get a legible copy of your current I-140, not the courtesy copy.
3. Get your H1 transferred. H4 is not needed to be transferred as the petitioner on H4 would be you or your current attorney. I would suggest you do a premium processing for H1.
4. DON'T give resignation notice until H1 is approved. Your new attorney might say, once filed you can join the new employer. NO don't do that in the current JOB environment.
5. Once H1 transfer approved, submit a polite cordial resignation letter. If you want a draft PM me. This is important to have a good relationship with your current employer. How ever bad your current employer/manager be. Just be polite.
6. Once they accept the resignation, get experience letters, you might need a corrected letters later once your new employer starts your new GC. The reason why I am asking you to be polite is for that. You might need to contact them again to get a corrected experience letter.
7. Start your new Job.
8. Do a address change if you are moving to a different place AR11. Do it online and make sure to say that you have pending applications that will trigger updates to your I-485, there will be LUD (Last Updated Date) changes. Do it for both yourself and your wife.
9. Now have your new attorney/new company file for G28 - "Change of representation". Along with this you need to submit AC21 support documents.
a. A letter from your new attorney that you are taking a different job based on your I-485 filing and pending for more than 180 days and using AC21 portability. Also he has to explain that your new job is "same/similar" to the job that you were doing. Provide the O*NET job code (Usually in the labor cert) and state that your new job matches with that old job code. Look up your code in this website O*NET OnLine (http://online.onetcenter.org/) and Justify your new title to be matching that. For eg. If your current job title is "Associate engineer" and your new title is "Sr.Software Engineer" an explanation as to why these two job titles are same/similar.
b. A letter from your new employer giving details about your new job and your duties, get those things in line with your current labor job description. And also should include the salary, don't worry about the difference, make sure it it not less than your current labor cert.
c. Include the AC21 memo attached.
d. Include the currently approved labor cert.
e. Include the currently approved I-140 copy.
10. When your new employer is ready to file labor, ask them to provide the minimum requirements for the job be Bachelors with 5+ years of experience or Masters. This is what makes your new job qualify for EB2. The next part is making you qualify for EB2, so if you are from India then make sure your Degree is a 4 year Bachelor degree and you have got 5+ years of experience already. Or if masters it should be 3+3 or 4+2 year Masters, in which the 3 and 4 are Bachelors (BSc, BE, B.Tech)
11. Once the labor is approved, file for new I-140 with a letter requesting for PD port from your previously approved I-140. You need to submit a copy of the original approval not the courtesy copy. I have explained this in detail in a different post, search for posts by my name.
12. Once I-140 is approved you have to interfile with your pending I-485.
I am at stage 11 so I will know more when I progress to step 12 will update you if you PM me.
The regarding the AP and EAD you can use it and your wife can use it. That will not be affected. I am not sure if there is a thread created under "interesting topics" for discussing investment options in the US. If yes, we can close this one.
Besides the house, the 401k, the ESPP and the stocks (which I've always shied away from), would the IV community provide inputs on the following:
1. the various investment options in the US.
2. good investment consultants that you know of
3. approx percentage spread of your investments
e.g: 10% in stocks, 10% in 401k , 50% in the house purchase etc.
I know this thread is not relevant to immigration issues but those are being actively discussed in other threads.
If you have green card , think about investing in US, otherwise invest in India

The only way out that I can see would be a self petition. Self petitions are complicated and very fact specific. It is not possible in a forum such as this to proprly advise you how, or even whether to file such a petition.

Best option would be to change status back to H4 immediately. Since you already have a H1B, in future when you get a real JOB, You wont be counted against the H1B cap, So you should be able to get H1B using premium processing pretty quickly and start working.
Also You can use your SSN even if you go back to H4.

Our case too transferred from NSC>>CSC>>NSC.
We sent our applications to NSC on July 27th but on the transfer notice, it shows Reciept date as Sept 17th and Notice Date as Sept 18th.
I called the Nebraska office on Aug 5th and she said that my Biometrics results weren't on the file.!!!! wheras i took them on dec 6th 2007.
But when she read my case details ,she mentioned the reciept date as
July 27th.However, i took an infopass appointment on Aug 11th , and the IO (i doubt if these guys are actual IO's though!!), said that my FB1 results and Biometrics have come back.I saw a soft LUD on my I485 on Aug 11th on the evening.
After that i got my EAD renewed from Nebraska.
Still waiting for the approval.

HI Guys,

More importantly last time when the I140 approval came along, it said CLEARLY that I could not apply for my 485. This time it says I am eligible and that I should contact the local INS office.
HAS ANYONE had a similar experience and does the A number mean the "immigrant visa number" by ANY chance??

Sorry for the late reply. I was out visiting my father.
Here is what I did.
� Applied the Advance Parole online the same day I heard the news that my father is not doing well.
� Told my family (back home) to scan all the reports and medical documents and send it to me via email.
� Booked �Info Pass� Appointment (I did not see the option for Advance Parole therefore booked it under EAD) for the next day I received all the documents via email
Took the following to the �Info Pass� interview
� All the medical records, doctors� analysis, CAT Scans & MRI reports.
� Advance Parole Receipt (Online application receipt)
� EAD Card
� I-485 & I-140 receipts (copies)
NOTE: I did not book the tickets before the �Info Pass� Appointment
Here is the �Info Pass� interview:
Officer called me ask me for the reason to issue emergency Advance Parole. I told the whole story and gave all the medical records. All reports were in the medical terms but fortunately in one of the report it was mentioned that this medical condition may because of stroke or brain injury.
Officer asked me to get all the reports in the layman�s language. I told officer that it may take additional week to get everything here and then requested him to please consider my case for the emergency Advance Parole. Officer told me to wait and then went to talk to the supervisor and I was told to wait in the waiting room. After 2 hours I was given the Advance Parole.
Here is the conclusion: Make sure to get the medical records translated in to the layman�s language.
Once again thanks to everyone for the valuable suggestions.

i have been there. More than once. No kidding. I was 'current' on three different occasions on Three different calendar years before getting greened. During that time I witnessed people with PDs behind me get greened and I saw the 2007 485 application tsunami as well. So I assure you the pain is as fresh as yesterday.
The time to act is before you are even current. If you suspect you will be or the visa bulletin makes you current, then immediately jump ito action.
Make contact and a friendship with your congressional aide. This is very easy, they are there to help you and are very receptive. You can leverage that relationship for many good uses. Remember he or she has the congressman's ear, and will get you access. You can use it to lobby for IV priorities, for your own personal gain etc. Everyone reading this should make this contact. If you have not then you simply do not understand how this country runs.
When you are current and you believe your case is 'approvable' then you call and ask them to press home the advantage. Understand that each year your window is narrow, so act soon and be multidimensional and quick in your actions. Each year you will get over one or two issues. For me one year it was a lawyer screw up, another year they lost the plot with the visa bulletin fiasco, then another year it was a positive TB skin test. In the end it was a relief in 2010.
So plan ahead, and use your congressional aide. Cultivate that relationship. It will be helpful in the end and if enough of you do it, then it might speed it up for all.

some of u folks are desi employers or just plain scared..i know several ppl who used AC21 after 180s... even if your ex-employer revokes I-140..its not at all a big deal.. u will receive a notice of denial and all u've to do is submit proof of new job ...
so chill.. if ur too worried..better file AC21 right after u change ur job..
in future if for some reason uscis issues another RFE.. resend the same info..
but its perfectly ok to move after 180 days...AC21 is the law and is there for a reason..go IV

No my FP for EAD was done about a month back. I have noticed that some have Code 1, 2, or 3, What I understand is that in the end everyone has to complete Code 3 before getting GC, so they may call me for another FP
