More times than not common sense goes missing among the highly educated. The trouble is, you mix that fact with added politics, and now you have a complete and utter mess. They are dumping money in businesses without making sure of returns. This economy is not going anywhere.... they can fool trusting citizens, but not people with common sense.

Hi, as per my thread title, I was wondering if I have to use my lawyer for the EAD renewal process. I am confident I know what/where/how to file the application and the materials necessary and because I am a little strapped for cash I'd like to do this on my own without having my lawyer do it and charge me for it. Bad idea or doable, what do you guys think? Thanks!:)

I had looked in to this about 6 months ago when I was up for an extension. Research showed certain pieces of the fees could be paid by the employee and still be legit. My employer ended up picking up the entire tab so did not have to pay anything. On a side note I did have a visit from uscis sleuths after the renewal and they did ask me who paid for the petition myself or the employer. just my two cents!

Despite all but one reasons to the contrary, we decided to use BA. That one reason was price (no surprises here).
We bought the tickets in January and waited till May for the date to come current, so we may travel on GC rather than DATV. As we all know, the date actually went back.
After a little bit of procrastination from both and some reckless assuming from my spouse, we reached a stage where we had a full Wednesday, a full Thursday and a bit of Friday left to apply for the DATV for my spouse from scratch and to get our kid's passport and post-biometrics documentation to the UK consulate and get back both their passports with DATVs.
The reckless assumption was that an approved but unstamped H1B (basically just the I-797 Notice of Action) was good enough to not require a DATV for my spouse.
Besides, we did not read the instructions on the DATV paperwork carefully enough to note that we actually had to Fedex the docs and passport to the consulate. My spouse just went by what the staff at the biometrics center advised, which was that you are done and good to go and basically wait for the visa (even with the kid's passport in our possession)! Yes, that was way dumb on our part.
So we woke up to this in the afternoon of Tuesday and soon had friends sending us information and offers of logistical help. My spouse applied for DATV online that afternoon and secured a Friday appointment for biometrics. That was the earliest available and was also the date of their flight!
Taking a chance, my spouse went to the biometrics center Wednesday morning and managed to get the fingerprinting done by 0815. Then we drove to the UK consulate, hoping they would entertain our case as an emergency.
We might as well have hoped for a date with Rapunzel. It was not ivory but it was a tower alright. My best people skills succeeded in persuading the lone security official downstairs in calling upstairs. However, as per his prediction, all that came down was just another security official who said absolutely nothing different, which in essence was: You are not allowed to go upstairs. They will not entertain ANYone (obviously excludes the President, the Queen and other such people) unless there has been a death (their accent made it sound like the word 'deaf') in your family (and we couldn't think of misusing that for our case). The window opens for visa agents between 0830 and 0930 and since it was already 1030, even a visa agent couldn't do squat that day. Applying directly is only possible through mail and it will take a minimum of 5-10 business days to get the visas. However, here is a list of visa agents with their contact info who might be able to help you get the visas quicker
Meanwhile, a lone visa agent was interacting with my spouse in the same lobby. He was in the printed list given to us and since he was already talking with us, we decided to go with him. He said he was going to charge us $100 per DATV for his fees. We were free to leave our papers and passports with him right then or we could show up at 0830 the next morning for him to take the papers in. We elected to do the former.
This guy then applied for our DATVs on Thursday morning and asked us to come collect them Friday morning (day of the flight), which we did. All went well thereafter and a little bit of carelessness cost us $200, loss of sleep, loss of work-hours but also reassured us that we have some great friends around us.
Here is the whopper though. Noblinkingbody ever ever asked to see these DATVs all the way from US till India! Is this then just a sham for law-abiders? Just emblazon some logicless words in some officious location and amuse yourself watching these worker bees make a line carrying them out at some undeserved expense to themselves?
You know what though! I asked myself if I would still apply for a DATV if required and with all this information in my mind, my answer was an unwavering yes. That's how I fear a lot of us might be made, which is why we continue doing the lawful and the right thing while accepting the step-parental treatment here in this country.

I've been speaking with her staffers for about 10 days now. They hear our questions and complaints, but not our thanks -- so please do call either the DC office to let them know how you feel. They will probably take the comment or transfer you to the House Immig Subcommittee office.
As for the House Immigration Subcommittee -- Lofgren worked with the counsel to this subcommittee to come up with the questions sent to DHS. She sent the letter in her capacity as Chair of the Subcommittee. So the committee is fully involved as well.

Continuity in insurance matters especially for pre-existing conditions to be covered without a waiting period. If you change insurance and show that there has not been a break in insurance it is US law that you will be covered from day 1 for pre-existing conditions by the new company.
About getting health insurance - find a health insurance agent in your town and talk to him/her. That agent will be able to advise you about the options. Generally HMO's are cheaper than a traditional or PPO insurance but you have to go to their doctors and hospitals. Some one suggested Kaiser Permanante and that is an example of a HMO.
Also to consider is the annual deduction - If you and your family are in general good health it is better to take a high deductible (say $2500 for family) policy as that will save you money. That way you out of pocket for annual checkups but the total cost may work out cheaper.
NOTE: DONOT take insurance from some fly-by-night company. It's money in the drain.

Police Clearance is required from both US and India. Do not submit your application with missing items as that increases the processing time exponentially. Getting your police clearance from India i.e. applying to the nearest consulate doesn't take half as long as it takes FBI to send you the clearance. I am in Los Angeles, applied to the consulate at San Francisco and got my passport back in 3 weeks. On the other hand FBI took its sweet time and it was almost 3 months by the time I received the clearance from them.
Regarding adding a spouse later on, that can surely be done. I got married after my application had been submitted for almost 8 months. It was a pretty simple process and the whole thing was completed in about 14 months, meaning I got the medical papers in that time. Hope this helps!

Even if you get Birth certificate you still need 2 affidavits other than parents since the birth certificate is not taken at the time of birth.

I think it not really more people. Only 85K people on H1B come every year. There are 140 K greencards. All H1Bs do not apply for greencards,
So the problem is country limits. Can someone calculate what would be the wait time if country limit is completely removed.
Honestly there is only one reason, remove that everything will be normal. that is AP ( Andhra Pradesh) . because i said truth, i will get bombarded with red dots and other comments, there is a high possibility that i will be banned.

The San Jose organizers are preparing a doc that goes into details of what we did, and what we should have done.
It'll take a few days since we are all still recovering - keep your eyes out for an updated post!
A couple of quick notes of advice from those just off the front lines:-
Give yourselves time to plan. We had less than a week to plan, and it was VERY stressful for a lot of people.
Join your state chapter, it makes communication a lot easier
I'd also agree that next Saturday with harry potter book may not be a good idea.
I'll have to double check, but I see no reason why we can't pass on the flyer, pamphlet and banner docs that we used.

I had two LUD's (04/09 and 04/10) on approved I140 (May 3rd 2006). This is due to the system upgrades as mentioned in many threads in different websites.. nothing more..my PD is EB2-Nov 2006..

Well the STEM graduates getting a green light to go in to the US workforce will go through regardless of any increase in the H1B quota. The US Citizen enrollment in STEM programs in the US Universities is perilously low, and no way the US will let these highly qualified group of young people go back and compete against US businesses. I think this measure is easy to pass, since the US will only be catching up with Australia, UK and Canada on this.
Actually according to me IV is trying too much that is hard to acheive.
Increase in H1 to 115k is fine. After that 20% increase every year is too much and there will not be any restriction and that may increase the immigration so much and that may be really threat to current immigrants as well as American citizens. Already lot of companies are applying Blanket L1s. Also exemptions for Stem+3 and MS degree holders will increase immigration so much and tough to get passed. I think just increase of gc to 300k will resolve the problem for next 5 years. Also it is easy to go through Senate and House. But if we keep on trying to lot of provisions that will dealy the process. If we ask exemption for those who are having PHD that is reasonable and that will increase number of scientists and we can justify.

he he!! now you guys understand why I opened this thread.. Look at the downside of having the CIR passed rather than waiting for the GC the other way.
There are chances that you may get the GC early, if CIR is passed but there is 101% chances that everyone will get stuck longer than now..
So guys be focussed and try supporting the recapture bill rather than CIR or anything even closely related to it. Supporting the bill is also like negotiating the situation and making the move carefully..

Also I am not against the H1b but supporting H1B at this time is like holding the hot iron in your hands as right now, as H1B is equivalent of IT frauds and job snatching program. So if you dun support H1B at this time and only try to get the backlog cleared up, automatically the path for the H1B holders will be clear for the faster GC and there issues will automatically will get resolved.. As far as the new applicants are concerned who will apply for the H1B in future they even dun have to worry, as the nexus between H1B and Consulting and company profit is too deep , so when the company would need they will make their way.
