I can still go to F1 till my labor and 140 gets approved and then I can apply for H1 extension based on this.
My understanding is that you can get a 7th year "extension" even if you are not in H-1B status. I do caution you about the F-1, in that is allows for limited employment and you are unlikely to be able to travel outside the US while in F-1 status. This is because it is unlikely that a consulate will issue you with an F-1 visa stamp. A consulate is unlikely to believe that you have the required nonimmigrant intent if you have been here for 6 years in H-1B status (maybe more before then) and your employer has started the permanent residence process.

Were you never employed by this company? Was the GC for future employment only?
I know one guy who lost his job with AOS pending. He shifted to H4 becoming a dependent on his Wife's visa and then started his MBA and later got his GC. He was an employee with the company from which he got laid off for almost 8 years .

Check your LC approval and it should there in the Occupation: Computer Programmer, <code>. Or if you have filed LC application than it should the value you put in Job Name field.

ANyone can answer these q's, I emailed my lawyer and never got a response . is it that complex?
1) I have an approved I140, so Iam assuming that I can renew my H1B for another 3 years, if needed (my current one reaches 6th year in Nov 2009)
2) Can I switch to EAD and then for whatever reason come back to H1B? Is that possible? If so, would that be considered as a new H1B (which falls under the fiscal year cap every year) or will it be considered as an extension of my existing/old H1B? ( I have an approved I140 and Iam at the point of more than 180 days since I applied I-485)

My friend became a US citizen after his GC. He got married 2 years before. His wife was in F1 and then got GC. She is 3 months pregnant now and need to travel with her husband's coffin to India in another two days. We want to consult with an immigration attorney soon, but before that we dont know what are the aspects we have to consult.
Following are some ex. questions. please provide your input for them..as well as any other missing items we have to consult with the attorney.
When she is in India
1. Will her GC be in valid status. How long can she stay in India without any paper work and return back to US. What are the paper works she need to do before going to India. Can she do the paper works in India itself.
2. If she delivers a baby in India, will the baby be a US citizen as the baby's father is a US (became) citizen (like person of american origin).
3. Can she claim Social Security benefits from India.
Does her GC status determines the collection of her husband's Social security benefit.

I spoke to an IO at the TSC a couple of weeks back when my PD became current. I had called to check the status of my application ...the IO mentioned that my namecheck was pending so my case wouldn't be adjudicated. However, the IO mentioned that because of a "pilot program" my case could be adjudicated if my namecheck was clear. I quizzed the IO further, she stated that only applications with current PD are considered for this "pilot program" where 140 and 485 are adjudicated together.
I gather the impression after talking to the IO that I-140 applicants whose PD is not current is not hurt or delayed by the PPP, instead applicants whose PD is current tend to benefit from this program.

Hi my EAD is expiring on Jan 12 and i have applied for a renewal 120 days in advance. I am worried that if incase my EAD card does not arrive on time, i may require to terminate my employment. My EAD status still shows as Pending.
I also read that USCIS does not do Interim EAD any more due to law changes. Is there any one who has faced this situation and knows what to do?
Do i have an option that i may be allowed to keep the current job and wait till the EAd arrives.
Please advise the best course of action so that i can keep my job and not get it terminated.

hopefully its not a big deal, i was just surprised to see so many emails from them after a silence of 2 odd years and yes :mad: , they have been known to loose (even shred) a lot of files during transfers.

As long as you are notified and when the time comes the case is going to get adjudicated by someone, what is the big confusion about ? Unless you know cases sent to a particular center are usually directed to the shredder !

My wife did a successful transfer from H4-F1 in her last semester and is now preparing to apply for her OPT. The university designated officials reviewed all her paperwork.
We submitted bank statements as a financial proof as a proof to cover first year expenses. The F1 was approved in 6 weeks.
