Lets send the letter to all the congress members and schedule a follow up meeting. Ask for their help to pass some resolution to ease the GC long line.
I will take the responsibility to modify this letter a bit and sending to GA congress member. Sending the letter and educating the congress member need to be done by the end of Jan'2007. What others IV member think? Any taker from other states?
I very well understand that sending this letter may or may not get the resolution passed but at least we can educate them of the monterous GC problem.

To my shock i received the information from employer that my perm got denied due to educational qualification not matched with the job req.My PERM was applied in EB2.
My H1B which is valid up to Jan 25th 2011 (6th year of H1B) and i went out of country for 7 weeks in overall 6 years...
My questions is what are possible options available to get extension after 6th year apart from 7 weeks of vacations.

You enter your email address.
You pick how you want the LUDs. soft/hard, how many per week, etc
You pick the randomized approval window: a week, a month of a year. You get to decide how long this fake approval torture lasts.So if you choose a month, you could get fake the approval email anywhere between now and a month from now... our system randomly decides when....

Hello, I am an Indian working in US for 2 years, I am on H1B visa now. before that I did my Masters in US. I did not applied for Green card yet. Actually I am going to marry a Russian girl in 6 months time. I want to know if I can apply for Green card under her name after our marriage. (can I do that?) Because I heard that getting Green cards for Indians takes lot of time. If I apply for Green card after she comes to US, then do we both get green card soon? I am not familiar with the green card rules yet. Any advice will be appreciated. Thanks a lot. :)

Now i am even not sure if they applied for Labor. I need to get some proof from them. For what document can i ask them for this? What should i do in this situation?
It is employer's choice and decision whether to file labor or not. Employee does not have any say or input on this.
Having said that if employer claims that labor was filed for you as beneficiary, you can request for case#. It is upto the employer if they want to share case# with the employee or not.
As a practical matter, employer should be willing such information with employee. Again, thats on the moral/ethical ground, not on legal ground.

So I had to tell him and now obviously he doesnt want to co-operate. I will try to reason with him again but considering the worst case can we proceed without these?
For 485, employer got us (all his consultants) to write him a letter saying we authorize the attorney's to sign on our behalf, to save time. So unfortunately we dont have copies of 485's.

You can still move without this documents, but consult with some attorney and find out how to obtain these documents with out your employers knowledge. I read on IV forum, someone quoted some scenario to use FOIA to get a copy of entire 485 file.

I think Anti immigraiton people will work hard to block any increament in immigraiton. While Latino group will work very hard for amnesty. Common ground will be decrease legal immigration for certain year and allow illegal to be legal first. then resume back to as it is. Also implement enforcement policy and stop illegal immigrants entering into USA.

During that time I witnessed people with PDs behind me get greened and I saw the 2007 485 application tsunami as well. So I assure you the pain is as fresh as yesterday.
The time to act is before you are even current. If you suspect you will be or the visa bulletin makes you current, then immediately jump ito action.
Make contact and a friendship with your congressional aide. This is very easy, they are there to help you and are very receptive. You can leverage that relationship for many good uses. Remember he or she has the congressman's ear, and will get you access. You can use it to lobby for IV priorities, for your own personal gain etc. Everyone reading this should make this contact. If you have not then you simply do not understand how this country runs.
When you are current and you believe your case is 'approvable' then you call and ask them to press home the advantage. Understand that each year your window is narrow, so act soon and be multidimensional and quick in your actions. Each year you will get over one or two issues. For me one year it was a lawyer screw up, another year they lost the plot with the visa bulletin fiasco, then another year it was a positive TB skin test. In the end it was a relief in 2010.
So plan ahead, and use your congressional aide. Cultivate that relationship. It will be helpful in the end and if enough of you do it, then it might speed it up for all.

As pointed out, the question is incorrect. You can do both (Transfer your H1 and use AC21). Technically, once you are past 180 days of I485 pending your GC application belongs to you. The only hitch here is you would need to maintain the same / similar employment.
If you have an option of transferring your H1 to a new employer (post 180 days of I485 app) - I would strongly recommend you do so. EAD for all it is worth needs to be renewed and throws you out of status if your GC application gets into trouble (God forbid).
