EAD can be used for any job, but in order to stand to your and sponsor's intents, on getting GC you should accept job for which you were sponsored (with the sponsoring employer, or with any other employer if 180+ days have passed from your AOS filing). But if you are doing something different in the meantime, it might raise a question on your intents, but nothing is wrong with it.

If using H1B you have to work in similar field.
In case you are invoking AC21 with EAD, first thing you need to note that, you have to have an EVL (Employment verification letter) from future employer with same job description or with same job duties and work for future employer in similar field. so you just cant assume to work in any field you want.

I just got notice from my employer for 485 petition return (Not I-140 RFE). USCIS sent notice on 09/26/2007.
Dear Applicant or Representative:
Your I-485 Application to Register Permanent Residence or Adjust Status is being returned because it must be demonstrated from the priority date of your approved I-140/I-360/I-526 that there is avisa available for you from your home country. Please provide evidence that your priority date does have visas available for your home country when you resubmit your application. All other adjustment applications must be filled at the local district office.

Try to find more info from USCIS toll free number. Ask your lawyer also. To me, it looks like a mistake. You filed on 14th Aug and all EB categories were current at that time.

So, if I file my EAD today (99 days before expiration) - will I still get a two year EAD considering my EB2 india is retrogressed? Or does it make sense to wait till June 30th? Please advice.

With all the opposition that all the immigration bills are facing, I see little light for them. But how about we call the offices and request them just to end the 'country limit' on Employment based Green Card. Let the Employment Based Green Card be given thru a Fair system and that should be FIFO, when there is no quota on the number of people that enters the country for employment, it is unfair to have a Country Quota for Green Cards. If they can come up with a 5 Line Bill for this, this bill will have least opposition...
The Kings/Smiths and likes can come up with 50 line amendments to a 5 line bill.
Need of the hours is to call the Judiciary committee asap.

Sorry if this question was already posted and answered in some other thread.
According to I-485 inventory published by USCIS if there are 6300+ pending application in 2004 alone for EB2 India what was the reason for forward movement of Jan 22 in the October visa bulletin?
As October being the first month of 2010 quota and as the spill overs are released only in the last quarter this is not making any sense to me.
According to the FOIA data released to the IV my position in queue is 3750. The forward movement in October makes more sense to me if the data released by USCIS to IV is the real one.

Thanks for organizing it. All Wisconsin Members, pls get active. Time is now to act. After we get the bill passed with our provisions, there will be plenty of time to relax and enjoy. We will no longer have to come on IV site everyday and see if something is happeneing and feel disappointed that no lawmaker cares for us.
You can make lawmakers aware and care for your cause, only if you go and meet them.
Lets all get active. After that we can watch Presidential debate, change jobs, get promotions and raises, start our business, visit our home countries more often, our spouses can also wok, our children can get scholarships etc etc

After paying Lawyer fees and sending him EVL, My Lawyer told me that Job is same or similar to Labour Certificate. but since you salary is double than Labour salary , it can create problem. GC can be denied. I used the same EVL as AC21, just date was changed.
I just want to know are there any case where GC can be rejected because of more salary. If this is the case what are my option, one of the option my lawyer told me to take Demotion in the current company where salary somewhere near to the Labour labour salary. Please suggest as I am very much worrried now.

I am planning to get stamping my H1 in US consulate Hyderabad. Wanted to check with anyone who has recently been there. My first question is
1) There is a question " Is your visa expired in past 12 months"? Can some one please tell me what this means? My last stamped visa expired in Feb 2009 so should I say Yes? But I have my approved I-797 petition valid till 2012. Can some one please share their experience on this question

Yes I filed I-90 and sent all supporting docs I had . BUT I did not have the copy of the Green Card..I LOST IT THE SAME DAY I GOT IT !.....I went to my old address to collect it. Returned back from work , went for a 1 hr work out. It was no ordinary Gym .24 Fitness with more than 100's of locations in every state out here. It was a very slack time ...and hardly 5 people came out between the time range of the theft , per the video cameras. The Manager refuses to let me see the cameras. Keeps telling me the same bull shit " We take this very seriously ...blah...blah.... so far we have no leads" ...and the PO / Detective in charge of the case only works Tue-Thurs. Never returns phone calls. I gave him so many leads but ...its the same.. or worse cop attitude compared to India . .....then if u keep asking them and following up ...they keep giving being defensive ...and there is nothing u can do to make them accountable.
Long story short - I mailed all other supporting docs but the GC copy . Birth Cert, Police Complaint etc, Copy of DL and Passport etc.
With the cops being such assholes, hell ya, I could just pretend that I never got the GC and filed I-90 and never be paying this $380 Fee !!! but it is GC......didn't want to take my chances of them rejecting my case....for some excuse.
How long will it take before I get actual GC. USCIS told me it can take upto 3.5 months +. Any idea about the avg time in real terms ?

I had issued 2 cheques $745.00 in the name of USCIS and my file is received by them on july 2nd. Now one of my friend was telling me that cheque should be in the name of Department of Homeland Security. and not USCIS.
Is this true? Are there any chances of rectifying this? Would my application stand chances of rejection for this? or cheques can be issued on any of these agencies and it would get cleared?
Kindly clear my doubt. I got tensed from the moment my friend told me this.
