My friend initially came on H1 visa. Her Husband was the primary applicant for Green Card and she was working on H1 visa without break. Now she is on EAD and joined a job in EAD got 2 months pay stubs( ie 8 weekly pay stubs). After that got 3 months break. Her status now is on I-485 and no more on H1. Note: Her husband was the primary applicant and she applied I-485 through her husband's GC. Now will the break in her work on EAD be a problem for getting her GC?.

Are you in desperate need of a job for monetary or immigration reasons. Since your EAD is valid until mid 2010, you don't have to worry about your immigration status.

Hi all,
Greetings! I need to visit Canada for a week begining 7/27/07. My lawyer will be mailing my I-485 mostly this monday. He recommonds not to travel out side US until we get receipt notice. My Canada trip is very important. AS per my knowledge we will not get new I-94 as long as we are traveling for less than 30 days to Canada. Any thoughts about the impact of traveling to Canada before we get receipt notice for I-485?

1 year extensions:
Looks like the question comes from the point of 7th year extension and changeing employer from employer that started labor and new employer. Even if your 7th year extension is not applied or not approved from the company that applied your labor, you can apply for H-1B transfer along with H-1B 7th year extension with the new company giving evidence that your Labor indeed was pending for more than 365 days. You do not need apply and wait until you get 7th year extension with your current employer in order to join a new employer. This way you are making INS rich by giving two fees' to get the H-1B approval for the same period.
7th,8th...year extensions are allowed even with the new employer based on the evidence that your labor or I-140 is pending for more than 365 days before your 6 years H-1B date is reached.
3 year extensions:
Once I-140 is approved you can get three year extensions provided you are subjected to retrogression, ie you cannot apply for I-485 because of retrogression or even though your I-485 is applied, you cannot get approval because your PD is not current. In this situation you can get 3 year extensions with the company through which your I-140 is approved and also from a new company along with H-1B transfer you can request 3 year extension showing the approved I-140 from old company and showing the proof that you are indeed subjected retrogression.
PD portability:
Once the I-140 is approved the alien owns the Priority Date and this date is inter transferable between EB applications (1,2 and 3). Alien owns the PD even if the I-140 is revoked by employer. The only case this PD is not owned by alien is when USCIS revokes the I-140 because it is fraudulent.

I xcalled NSC again and talked to a very nice IO .she was up after she jad her starbucks:).initially reluctant to give any infi but some how she melted and talked for about 15 minutes .here what she said after getting reciept notice and confirming name .
Last definitive action on my file was july 15th when i was sent a notice that my case is reopened .
No IO or CSR would be able to tell if biometrics are attatched to file or if PD is missing .only the officer who has the physical file can tell it .
she added even info pass people dont have that information about biometrics of PD being missing .
I tend to believe her but i cant say if our friend who went for info pass are wrong .Hard to decide .

You have a good suggestion. However, I would like to point out that in the past IV only had a $50 or $100 recurring option. IV members then had the same argument that if we have a smaller option like $25/month we might get more members to contribute. Now that we have that option, we want $5/month.
There is an option for members that only want to do $5 a month. Do a $60 one time a year. The problem with setting $5 option a month is a lot of the $5 will be eaten by fees (Transaction fees. Ex:Paypal fees). If members send checks, can you imagine having to collect $5 checks from 100 people and depositing it. That is a lot more work for IV Volunters (whoever is doing the accounting).
Frankly, We have a lot of members (approx 30,000). But only a small fraction of those contribute. We cannot achieve anything with the small sum of money we collect with member contributions. While, IV recognises that it is a tough economy and appreciates recurring contributions, The fact remains that it is just not enough. We are up against non-immigrant lobby groups that raise 20 times more money than us.
All members need to contribute, but we all know that is not going to happen. Only a few members will contribute. Those of us who do contribute, should try to do atleast $25/month recurring. Alternatively, members can always do a one time contribution of any amount.

I think, if by June 30th if your application is pending, you will get your EAD extension based on this new rule i.e 2 year of PD is not current or 1 yr if PD is current on 30th June. People will start seeing it in a couple of weeks after June 30.
I guess, it makes sense to aaply it now if you can as based on USCiS speed, you will most probably be pending by June 30.

The Permanent Resident Card cannot be completed because the biometrics have not uploaded into the system. We are looking into the databases to see if the images can be found.
Did anyone received a similar reply?
I gave my fingerprints last thursday (September 4, 2008).

I have a related question. If my I-140 is approved and if my Passport expires in 1.5 years, can I still get 3 year visa? Do I need to renew passport for 10 more years before I applu for H1B for 3 year extension?
