Is it required for intitial evidence.
My attorney did not even ask for it.
As far as i have read in the forumns earlier, it is not an intital evidence.
Can some one clarify on this?
Yes I agree Akhil. This has never been asked and even I was not asked to submit it. But I think each case would be different. How much is your prevailing wage and how much do you earn, how many dependents etc. etc. So the guy needs a proof to see whether there is indeed something or not but again this is my guess....my attorney never asked me submit W2 or IRS Tax returns..! I got all the receipts as well. I am surprised that these things have been asked.
So I guess this person has no option but to submit all this to satisfy their requirements...but yes I am surprised becoz this is never asked.

While applying for I-485, can we use the Birth Certificate issued by the Indian Embassy in Washington. Or do we need to produce the original certificate from the Indian hospital.

If you need to file _485 immediately then you can submit the Embassy issued 'Birth certificate' but it would not be suffiecient for the purpose of 'adjustment of status'. Most probably it would result in an RFE asking for other 'proof' of birth, for example early medical record, early school record etc. Plus, affidavit from parents and relatives.
USCIS gives more weight to 'Affidavits' than to 'Embassy issued Birth Certificates'.
If you have time on your side, arranging these documents would avoid un-necessary and aviodable RFE.

Was your FP appointment a "Code 3"? I managed to get a infopass appointment on Nov 14th(more than 90 days from receipt date) just to be on the safe side. Lets see what happens.
I think adults (14 and above) have Code 3 and children have Code 2. Anyway, I have a feeling that they are processing by receipt dates.

I did make a photo copy of the EAD. I did schedule an appointment with info pass on Monday. I'll see how it goes. I'm hoping I do not have to wait anther 6 months. I'm worried with all this fiasco it will take long to correct the mistake.

There was a mistake in my EAD card once and called USCIS & my lawyer and both said I have to send the original EAD card with new filled & signed EAD application (I-765) and all supporting documents (EAD application I-765 & supporting documents mentioned in I-765).
I took photo copy of my original EAD (that has error) before sending it so that I will have proof of their mistake and also wrote cover letter about the mistake USCIS done (I even kept a photocopy of my EAD card and circled the error and asked them to correct it so that it will be easier for them to find the error).
I sent it to USCIS i.e. the entire package and they verified all my details and realized it is their mistake so they sent me the new card with proper details. Since it is their mistake they didnt charge me. If it is your mistake then they will ask you to pay for the EAD i.e. EAD processing fee (if you made mistake like any typo you or your lawyer did in your EAD application you have to pay).
so dont worry but you will have to wait for atleast 10-15 days to get it corrected. so call them and your attroney and get the details and send it to USCIS soon. but it is important to take your EAD photocopy before you send it and keep it in your records. also follow up and send it overnight through fedex/ups/courier for safer/quicker delivery of your packag and you can track too. good luck.

If the USC is available with that skill set, no appeal, end of story, period. It is up to your company to file for another labor.

My opinion, its one of the stupid move to change jobs now. Going to contract from FT that too you have a better salary....
Whatever it is at this point they is no point in changing employers. Who cares whether it is microsoft or google doesnt matter....get your GC and your freedom and do whathever you want.
Wait for 2 more or even less yrs at your present company as FTE.
Joining consultancy at this stage is inviting troubles. Never trust any consultancy...they say 1000 things before to get in once you are in....everything is under they control...you are a pet....

Thanks for replying guys, yeah I am not sure wether my privious employer has revoked my I140 or not, I just wanted to know what should be my next step. I have still not got the the RFE paper should I wait or call USCIS to know what is RFE. Please any help at this time is appricated, as I am losing sleep.
My only advice would be to hire a good attorney who can tackle this RFE, you have waited so long and almost on the verge of crossing over, don't take any chances.
It is clear from your first post that your approved I-140 is revoked by petitioning employer however it should not be an issue since you are on EAD and utilized AC21.
Usually the RFE takes about 5-8 working days to reach either you or your attorney(if you had filled in G28 form - the right to represent), contact USCIS if the above time has passed.

What your lawyer is suggesting you is a pure fraud. I'm amazed how many unethical lawyers are out there. The thing is not about whether USCIS "will have a chance to look". USCIS will be able to review your case at any time, even after you get your GC and even after you get your citizenship. I knew a guy from Iran who was in similar situation he got his GC and many years passed. After 9/11 his case was scrutinized, his GC revoked, he was arrested and deported. Do you want to live in fear the rest of your days in US? If you don't, then find another job, port your PD (it's easy, since you have I-140 approved, the company can't revoke it) and do it all over. I know it's frustrating, but it's a "right" way. If you get lucky you will have your PERM in 2 weeks and if your PD is old enough, you will be able to apply for 140/485 starting from Oct.

Joe Wilson's outburst during the speech has been roundly condemned by everybody. It should be, without a doubt.
But, I also would like to place Congressman Wilson's service to immigrants in perspective, especially his being immediate past Co-chair of the Caucus on India and Indian-Americans.
He has been always responsive to the concerns of Indian-Americans. I have heard him address a meeting of Indian-Americans in 2006, and he was very responsive to concerns of the immigrants.
I think his views, however simplistic & naive, are representative of most Americans - NO to illegal immigration! There is a fear that illegal immigrants get access to healthcare, which is limited in so many ways!
But, most Americans approve of most legal immigration, which may get conflicted in the current economy! His views are also political, as are the views of his opponents! In fact, the Democrats/ Hispanic caucus have been responsible for blocking all legal solutions to the problems of the legal immigrants! I would not care one bit for them - because they do not care for me!
I do not know what is inside those Healthcare bills, but I believe the President when he says that no illegals will have access to healthcare! But, I also believe that Congressman Wilson & Republicans have the right views on legal & illegal immigration! I do not condone his outburst, though!
