he had 7 days of leaves and those guys said they are going to pay him for those instead of even giving him those leaves now and not cancelling it now. They are adamant to send cancellation immediately, might have done it already dont know.
Usually employers do not entertain such things because they have to pay other benifits like insurance etc...So, for them paying 7 days salary is economical than extending employmeny by 7 more days...
Other than that, I don't think your friend needs to worry. Just ask him to believe how lazy USCIS guys are..I mean it takes months to open the application, issuing Receipt Notice and updating the case etc...It takes years..you know what I mean...Your friend should be fine...

if you read my post clearly, USCIS asked since my last admission has been authorized by USCIS (My last authorized entry in US is only 5 months back i.e December.
USCIS never asked about my previous employments in 2007. So I am confused weather to tell USCIS now about the mistake I made during my I-485 filing or Just don't worry about it.
Any how I am talking to attorney, I will let you guys know as soon as I get get some info, Please give some constructive advises ...

* Conservative Republican Rep. Issa of California introduced a bill to eliminate the diversity lottery progam and replace the numbers by the U.S. educated STEM Ph.D. immigration. This bill has been pending in the House Judiciary Committee.
* Yesterday, another conservative Republican from the Virginia, Rep. Bob Goodlotte, introduced another bill, H.R. 704, with 12 ultra conservative Republican cosponsors, to eliminate the diversity lottery program. (VA).
I appreciate we are all in queue to have that resident card. Most, if not all amongst us have been fortunate to have an education, travel, find work and a livelihood here in America. However, there are the less fortunate who may not have the opportunities (or the possibilities) The Diversity Lottery program extends that possibility to those less fortunate, restricted in their lives for whatever reason and so on. Giving people an opportunity so they too can have a better future is (one of the) beauty of this land. This also brings more diversity to the land, where people of different backgrouds / origins come together. Personally, I find it all quite fascinating, because I grew up in a multicultural town, where people hardly integrated. Everybody formed their own little “towns”. Anyway, I for one, do not support the removal of this program in its entirety, because I do not believe someone with a Masters (I have one) or a PhD education, should have more privileges (in addition to what's on hand) to folks who may not have any? Anyway, it’s just an opinion.

I have decided to change my job after being a full time employee at the same company for 5 1/2 year. I am a electrical engineer by profession and have two masters degree from US in EE and Biomedical Engineering and Bachelors from India.
I have an offer from a consulting company whose direct client is Microsoft. They want a vendor engineer on a 1 1/2 year contract which, according to the company, have good chances of being renewed. The pay is much better than what I am earning now. They are willing to do initiate the green card process as soon as I come on board.
My questions are
1) When should I give the two week notice ? The company is insisting me to start as soon as they send the H1b application while I am insisting I will give the two week notice to my employer after they send out the application. I tried telling them that I will join after they get the actual approval but they are not willing to wait that long. Do you think if its worth the risk ?
2) This is not an IT job. The company has around 30-35 employees most of which work as contractors for MS. They have only sponsored one H1B till now. Do you think their inexperience can be a risk ? They are using a lawyer to do the H1b filing.
3)My priority date is Nov 1st 2007 and I have an approved I140. At this stage would you take the risk of changing jobs and going on a 1 1/2 year contract .......or stick to your current job for another 1-2 year till your PD becomes current.
4)My wife will be going to India this summer and will need to get H1 stamping. Do you think she will have problems getting visa since I am changing jobs and will have only 2-3 paychecks with the new company by then. Also since this is a contracting job is there a risk in getting H4 stamping ?
5) I am not sure if the new employer is apply for premium processing. If they don't how long does it take to get H1B approval from the date of application.

I don't think Dhundhun is talking about visa stamping. It just sounds like a two day trip. Different people have different experiences at the POE if you're driving.
It has been smooth for me with a passport that has a valid I-94 sticking in it. Just a few straight questions: Where do you live? Purpose of visit to Canada? How long? Are you bringing anything back from Canada? Have a good day.
I don't think Canadian immigration takes your I-94 upon your entry to Canada.
akilaakka: The scotia bank deposit slip is a recent procedure change. You have to go to a Scotia bank branch (pick one near the consulate) and deposit the specified fees and take the deposit slip with you to the US consulate. Check your appointment time and plan to get to the bank at-least an hour ahead of the appointment. Most Scotia banks open at 9am so if you have an early appointment, plan to get the deposit taken care of on the previous business day.

Conclusion: While these protectionists are around they will not let any immigration occur
However Senator Cornyn and others' resolve will be rewarded in the new year. Democrats will take over all important immigration committee positions and voting leverage over from these do nothing congressmen. Be happy that republicans did not win majority or there would have been more of the do nothing stuff

I have filed for a H1b Visa through a US based small consulting company. I was in US working on a L1 visa with another company when I filed for an H1b through this small company. After that I retuned to India where I am currently based out of now. I am supposed to go and get my H1b visa stamped in the near future.

My wife got a different response today.She got this message.
The status of this service request is: Service records indicate your application is pending the availability of an employment based Visa.Your application will be processed when a Visa based on your classification becomes available. You are invited to visit the Department of State website, www.travel.state.gov, where you can view a current bulletin regarding Employment Based Visas.
Also the response I got for SR is

However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below.........
Both of us have the same PD but different responses.

Ask your new company to file H1 transfer ASAP with PP. Your H1B transfer to new company will be successful until USCIS makes a decision on your old company's cancel request. Please consult your new company's attorney.

As I said, I talked to a very famous lawyer in the West coast and he thinks 140 PD is lost if your employer revokes it. He also thinks USCIS is not consistent in this and can very well still give you the original PD inspite of the 140 revocation. But as per law, only one PD per labor. So, if someone uses the underlying labor you cannot reuse PD.

I and my spouse are both on H1 and have our EADs as well. I have an oppurtunity for a side project. Is it possible for me to use EAD for this project alone and continue with my primary employer on H1? (I am not the primary applicant for the GC and am a beneficiary for the EAD)
