he had 7 days of leaves and those guys said they are going to pay him for those instead of even giving him those leaves now and not cancelling it now. They are adamant to send cancellation immediately, might have done it already dont know.
Usually employers do not entertain such things because they have to pay other benifits like insurance etc...So, for them paying 7 days salary is economical than extending employmeny by 7 more days...
Other than that, I don't think your friend needs to worry. Just ask him to believe how lazy USCIS guys are..I mean it takes months to open the application, issuing Receipt Notice and updating the case etc...It takes years..you know what I mean...Your friend should be fine...

However, may I suggest that in future ads, maybe you can include pictures of people from different fields also stuck in the GC backlog (eg. nurses, teachers, etc.) This will drive a point that the GC problem is being experienced by highly skilled, educated people from different professiona fields.

You should be able to come back on H1B and she on F1 because she does not have an 485 pending. Unless she has 485 application pending she should have no issues using F1. If you go this path you can apply her as dependent later (post marriage) only when your PD is being current and USCIS is accepting applications.

Well, its come that time where I am frustrated and fed up with my job and ready for a change. I am however, feeling rather trapped by this process and lost as I don't even know where I am in it. Maybe someone can give me some advice.
I have filed everything through a lawyer, who I feel works more for my employer than for me as that is who pays the fees. My I-140 was filed i'm guessing around April/May of 2007. I recently asked if that was approved, but apparently that is privelaged information i'm not entitled to. My receipt for my I-485 is Sept 2007 and I am currently working off an EAD, my second one which I recieved this past September.
I NEED to change jobs. I can not, and will not, stay at a place that I am miserable at. I just have no clue how to go about it. I already have a lawyer, but as I said, I feel they work more for the employer than me, and so I am hesitant and mentioning a change of employers for fear that will get back to my current employer. Would it be wise to find my own lawyer? My I-485 has been pending for well over 180 days, but it appears the key to being able to use the AC 21 portibility is to have your I-140 approved, and how am I supposed to be SURE that is approved if my lawyer is not willing to share that information? If it is approved, I should be able to change employers with out any problem, correct?
As much as I want a change, I don't want to run the risk of hurting my green card chances. Thank you!
I can understand your frustration. There is no need to get upset. This is US of America. You can get the information that you want and its within your rights. You can (try) call USCIS customer center and ask for the receipt number of I-140....most of the time, they don't give out over the phone but if you are lucky you can get the information. However, this is not the prudent way to get the information.
You can file for form G-639 with USCIS. Its the Freedom of Information/Privacy Act Request. Go to the following web site and initiate the request:

I believe, it would take 2-3 months to process the request.

In my case they did not took I94 at border, However They removed it in US consulate before stamping.
Immigration officer asked me about my I94 while re-entry into US, I told them it is removed by US consulate. They issued the new one.

Friends, if I already have an EB3 application pending for April 2006 PD and my friend is willing to file EB2 application while I continue to work on EB3 with present employer will my current employer find out ?

a- skilled workers moving to the US and reviving the manufactoring base and this might involve reducing wages of course.
or
b- prevent skilled worker migration and instead import products from outside which will be effective on the short run due to the present capacity for borrowing heavily??

As part of Team IV I took ownership of organizing IV professional networking events and had some time carved out this weekend to put some thoughts together on how to do this. We already have a linkedin group for Immigration Voice and I have become a member of this already. I will be glad to work with you on this.

I have been a member of IV for sometime. Over the year i have seen increasingly disheartening posts from people from being abused by their employer to being let go at a critical moment of their GC process where they are left with very little options. The reasons for people seeking jobs within the IV community are many but most of them seem to center around difficulties in H1-B sposorship, GCs, longevity of process, hardships etc. I know that if i was ever in this situation that it would be great if i could use the community's help to get back on my feet if i needed it.
I thought about an idea to create a free Jobs and referral portal to help people in their hour of need. Here are my thoughts & assumptions going in:
1. members of the IV community probably fall under these categories:
a) empowered to hire directly (manager or executive)
b) in a an influencing capacity (reccommend or work with hiring mgr)
c) refer but cannot influence - are aware of job opportunities within their environment that may be difficult to locate in a portal like Dice.
2. members of IV generally work for H1-B and GC friendly companies.
3. Members of IV will be able to give better insight and job prospect opportunities from their enviroment than any job site as they witness the requirement, opportunity, political env, etc first hand to be able to reccommend.
Essentially i want to create a portal where we can match IV job seekers with Job opportunities based on our our hierarchy of influence. we can also think about prioritzing the need based on situation:
1. Lost job & need sponsorship asap
2. Need to be free from terrible employer
3. Just looking for better opportunities with GC friendly companies
4. etc
I am a non-technical person (IT) so I am not even sure on what kind of portal this would be. I am right now looking for feedback from all to know whether this is something that everyone would be interested in, and if so, whether people would be able to contribute some time towards development (at least the techys amongst us).
Any ideas, suggestions and opinions (good or bad) are welcome!

Petitiononline site is a junk website.
It is a website of people who want to stay unknown and want to feel fake happiness that they have signed a petition. Who cares about fake signatures on that site. I can sign as Bill Gates or Tom Hanks or Julia Roberts on that site and nobody will know. I can even sign hundred times and make up numbers.
Those signatures are useless.
Only illegals should be using petiononline site or should be afraid of sending letters. Unless you suggest we are all illegals and overstayed or are without visas in this country.

My understanding is the same, I don't think this is anything new - again we don't know on what basis do they select cases to be transfered to the CSC or VSC though.
Whenever I checked it was always like that, atleast for the last 6 months! What is new now? All the centers showed a processing date even before.

I myself got 3 separate H1B approved before deciding on one company. The other two H1B approvals I simply tore away.
