some of u folks are desi employers or just plain scared..i know several ppl who used AC21 after 180s... even if your ex-employer revokes I-140..its not at all a big deal.. u will receive a notice of denial and all u've to do is submit proof of new job ...

You can use a previously approved I140 for a new case BUT please let us know that this is not applicable globally.
a) If you refile a new petition from the same company, you have no problems as your old labor still is yours.
b) If you refile from another company and if the previous company uses up your labor and files I140 for another person, the I140 date is no more yours.
c) If you refile from another company and if the previous company revokes the I140, the date is gone.
My company is planning to move me to another location and I fall in category (a) as of now. When I came to know about it , I did get the idea of jumping ships and keeping my PD but soon found about (b) and (c) from another lawyer. Maybe I'm still wrong.... Can someone confirm if (b) and (c) is correct interpretation on my part ?

Things have changed since 2006. I haven't changed my address yet I'm still required to go in person. All non-US citizens must do this in person (at least that's how it is in GA).

I am in boston area & if we are planning for a rally count me in.

My receipt number starts with WAC (CSC-TSC), my wife and myself got approval email on 4th of Sept.
Here is what I done, not sure that triggered approval:
On Sept 2nd, we called up National Service Center and opened SR.
Took an info pass for 4th, on 4th morning prior to appointment we got our approval email.
Just be patient and hang in there, you will get there.
RD: June 2007(CSC)/ Sept 2007(TSC)
PD: May 2004.
Good Luck !

It is a good write up...
The senate and house bill numbers expired with the last congress.
I guess either you have to ask for a new bill or refer to the bill as the bill in 109 the congress etc...
Writing a subject line like 'Please support legal high skilled immigration' would help...
In absence of a proper subject line they would throw a standard cookie cutter letter at you...
Another suggestion is not to talk about border security at all...
Write smaller and more specific to legal immigration..

This is very very sad. Why apply for a H1B when you wont use it. Completely unethical! I have known people leaving the country because they couldn't file H1B in time.

I am not sure the A number on the 140 approval had anything to do with a visa number. I am saying this because my PD is July 2006 and I have an A number on my 140 approval notice; and I know EB2 India PD is not current.

Just wanted to add my voice to this debate on H4 validity when H1 is transferred. If the H4 is still valid and I-94 is not expired or expiring at the time of the transfer, it is not necessary to file I-539 to extend H4 at that time. When I moved from one employer to another in 2003, I did not file an extension for my family's H4 until their I-94 was expiring in 2005 when I filed I-539 and got an extension until the end of my H1 in 2006.
However, some lawyer advise that you should file I-539 for your family at the time of moving to another employer just so you do not forget to extend their stay at a later date.
So, to the OP, your family's H4 is okay but do not forget to file an I-539 when their I-94 is expiring.

I am getting mixed answers, I have asked some people and they are saying that I need my wife's h1b stamped on her passport and some are saying its not required just the I-797 and all the other documents.

An H4 visa is not gender selective. This is NOT a problem. My husband was on an H4 for more than six years and got his visa stamped in our home country at least three times without me being there and me having a current visa in my passport twice.
Just go to your mother and get the visa local to her home. Take your approval notice, your wife's approval notice and the relevant forms all filled in which have been listed in a previous posting.
