Do people really care?
A reputed local channel is producing a documentary on the contributions of the immigrants to the economy and the difficulties they have to face and have to overcome to survive here and Highly Skilled Legal Immigrant group will be one of the three groups they will be focusing on. Pdakwala one of the co founders of IV has been working with the channel to make sure that there is coverage of the challenges we the Highly Skilled Legal Immigrants are facing due to the present outdated immigration process.
My wife and me both Highly Skilled Legal Immigrants will be a part of this documentary. What I intend to do is ....to send a detailed document to the producers mentioning three points so that they have a clear understanding of the contributions we make and the issues we are facing
1. The economic and cultural contributions the HSLI's make.
2. The Competitive advantage this country will lose if it does not make immediate amendments to the broken Immigration process.
3. Debunk some myths such as H1's dont pay tax, H1's take away jobs etc
I know I can find sufficient information if I browse through the various threads of IV but I am posting this for two reasons
1. I want input in terms of how to eloberate this specially point 2 and point 3
2. Constrain of time -- I need to send out the information like ...yesterday ;)

Thank you for that concise information.
But you still need the proper job code or atleast the right description of duties for the AC21.
How long will this employer make money out of me without giving me my proper due? (just whinning)
I wonder if there is another legal way to make such employers be more responsible ?
Thank you.

I can still go to F1 till my labor and 140 gets approved and then I can apply for H1 extension based on this.
My understanding is that you can get a 7th year "extension" even if you are not in H-1B status. I do caution you about the F-1, in that is allows for limited employment and you are unlikely to be able to travel outside the US while in F-1 status. This is because it is unlikely that a consulate will issue you with an F-1 visa stamp. A consulate is unlikely to believe that you have the required nonimmigrant intent if you have been here for 6 years in H-1B status (maybe more before then) and your employer has started the permanent residence process.

Update on experience:
After my mistake in entering the 'A' number, I went ahead and changed address again as per suggestion from USCIS representative and lawyer. Update is as below
--------------------------------
I could change my address using the 'A' number in AR-11 and I did get a new confirmation number for AR-11 address change. However when I entered the petition number for a pending petition, the system said that I have already changed address on the petition and it has been less than 45 days since I changed and also asked if I have moved again.
When I answered 'no' I got the following message:
"At the time you previously notified us of your address change, you were informed that we would send you a confirmation notice. You were also informed that it may take up to 45 days from the date you notified us to receive that confirmation notice.
It has been less than 45 days since you notified us to change your address.
If you do not receive a notice of confirmation that your address has been changed on your application/petition within the 45-day period, please call customer service at 1-800-375-5283 for further assistance."
----------------------------------------------------------
Any thoughts, inputs will help.

Collaboration with DOS
USCIS works with DOS more closely than ever to exchange information that is critical for managing visa allocation and for targeting future production efforts. We are now in weekly contact with the Chief of DOSs Visa Unit to communicate current inventories per country and preference class to better determine each months visa bulletin. DOS provides regular updates to USCIS on past visa number usage and remaining numeric allocations per country and preference class. DOS also shares its forecast for priority date movement in upcoming visa bulletins so that USCIS can adjust production in advance for maximum visa number usage.
USCIS and DOS are also working together on a plan to forward all approved family-based visa petitions to DOS, including those where the petitioner indicates the beneficiary will apply for adjustment of status in the United States. This will enhance the ability of DOS to accurately forecast demand for visa numbers and more precisely manage the establishment of priority dates to meter the intake of applications for adjustment of status to match visa availability.
Conclusion
Though we still have challenges to overcome, USCIS is currently showing improvements as a result of process improvements. As of April 25, 2008, USCIS had adjudicated over 65 percent of its FY 2008 target for employment-based visas. With five months to go in FY 2008, this is a strong start. We plan to continue implementing process improvements and new reporting mechanisms for managing these important applications.
Over the years, USCIS and DOS have strived to work in concert with respect to the Visa Bulletin process. After the events of the Summer of 2007, this year, we have built on that foundation and are better equipped to accurately assess and effectively manage the process to ensure that all available visa numbers are utilized. With five months left in FY 2008 year, we are confident this partnership between USCIS and DOS will provide the blueprint for continued success in managing visa allocations.
I look forward to updating you on our continued progress and am pleased to answer any questions that you may have at this time.

I just wrote a letter to Massachusetts (where my family live) senators Kerry and Kennedy expressing my experience and frustration caused by the delay of green card -- I am not on AP or EAD even because I missed the July wagon.
I also send the letter to the first lady, fed's chairman Bernanke, House speaker Ms. Pelosi, our friend Senator John Cornyn, Secretary of State Dr. Rice, The letters are all printed and signed, then sent by first class mail.
I didn't post my original text because I don't want the senators receive letters that are exactly the same, that look more like a spam.
Do you want to send letters of your own? Take 30 minutes and that may change your life, I am sure many of the facts listed below are not clear to many senators.
In the letter, I told the senators:
- I graduated from a US university with an advanced degree in engineering. I have been working for several big companies on important products. My achievements include: innovative algorithms for early diagnosis of certain type of cancers (using data mining and other bioinformatics methods), IT products that helps companies follow the Sarbanes-Oxley Act requirements much easier. Currently, I am working for a major health care company as the enterprise architect to streamline the clinical trial process so that shorter new drug development life cycle can be achieved, which may help save many people's life
- I have been in the US for 9 years, obeying every law, paying tax for every penny I earned. Up until now, I have paid $xxxx.xx in mass state tax, $xxxx.xx in Federal tax, $xxxx.xx in Social security.
- I have saved enough money, but can't buy a house right now. Because my H1B is close to its six years' term, I don't want to risk such a big investment with uncertainty in very near future
- My wife has a PhD degree from a US university in cancer research, but her ability of doing research is severely limited, because many government funding grants are only available to green card holders and citizens.
- If you calculate how much were invested to educate me and my wife, the total dollar amount is $250,000.00 (our stipend and tuition paid by colleges added together).
- During the years in the US, we have been educated by US colleges, earned skills and experiences that'd make this country very competitive. We contribute to tax avenue both state and federal level, we help supporting the social security system. We have the money to buy houses, yet we can't because of the uncertainty in future.
- The most important thing is, millions of other law obeying, high skilled immigrants are in similar situation, and are having their lives on hold. Many of us tend to save and are reluctant to spend due to the uncertainty caused by working on temporary visas. Imagine how much buying power will be unleashed if all of us are able to have our green card in a reasonable time period.
What we legal high skilled immigrants want:
- We want a reasonable time frame to get green card. Currently, the waiting time for China is 4 years, India is 6 years, and other countries are also 6 years if they are in EB-3 category
- We want a short term, quick fix for now, instead of a comprehensive change after a year or two years
- We are NOT asking citizenship as many Americans would think, at this stage, we only ask for permanent residence.
What a congressman can do to help us and keep this country's edge as a global leader without a major change in law:
- Increase the quota for green card each year
- Recapture unused green card quota in last ten years
- Waive those who have advanced degrees from US unversities
I do understand not everyone on this board has US degree. So please don't flame me on that. With the current situation, every effort to free even one quota is worth trying. One quota saved is one quota earned.

Thank you. I have a question for you. My priority date wasn't current when i filed WOM. They have mentioned about this and the recent retrogression in the MTD. How to defend on this issue?
Thanks again.
I also maintain a spreadsheet of favorable cases (you can refer to those in your opposition). Check it (you'll need google account) and look for cases from your district.

Thank you for your advice.
What is the definition of a similar or same type of position in the new project.
My GC was applied in a "SAP type of implementation position where my education of Mechanical Engineering would help in modeling business processes into ERP". But my resume that was submitted has Java and other programming skills also
But in the last 4-5 years I was working on Networking and Systems Administration.
So if I work in this area (Networking and Administration), will there be a conflict.
My resume now has multiple skill set including Java and other programming langages including the AS/400 midrange systems.

you do not need to have a H1 or H1 visa stamp when you return from canada/Mexico provided that you are returning back to USA with in 30days and do not apply for a visa abroad and you have never been out of status. I am copying the quote from a University website. if you want more information, then Google for more information and the restrictions involved in this procedure.
"Automatic Visa Extension for H-1B (or H-4) Visa Holders
An H-1B visa stamp may be considered to be automatically extended upon application for readmission to the United States (therefore, your visa stamp does not need to have an expiration date that is in the future), if you are returning from Canada or Mexico and are returning to the United States to resume H-1B status, provided that you:
are applying for readmission to the United States after a temporary absence of not more than 30 days in Canada or Mexico;
have maintained lawful H-1B status and intend to continue doing so;
present a current, unexpired Form I-797;
present the most recent Form I-94 reflecting H-1B status;
present a valid passport (unless exempt from passport requirements);
do not require a waiver of inadmissibility under Section 212(d)(3) of the Immigration and Nationality Act; and
apply for readmission within the authorized period of initial admission or extension of stay."

They also have an oversight role. They have subpoena power and must confirm some administration appointments. I would say that adds up to a lot.
Remember what Zoe Lofgren was able to do for the community from her perch in the house. Now imagine Grassley-clones in similar positions.
Enforcement is not the job of the committees...Committees pretty much draft bills...Quoting from IV Wiki:
"Each bill goes through several stages in each house. The first stage involves consideration by a committee. Most legislation is considered by standing committees, each of which has jurisdiction over a particular subject matter, such as Agriculture or Appropriations. The House has twenty standing committees; the Senate has sixteen. In some cases, bills may be sent to select committees, which tend to have more narrow jurisdictions than standing committees. Each standing and select committee is led by a chair (who belongs to the majority party) and a ranking member (who belongs to the minority party). Committees are permitted to hold hearings and collect evidence when considering bills. They may also amend the bill, but the full house holds the power to accept or reject committee amendments. After considering and debating a measure, the committee votes on whether it wishes to report the measure to the full house. "

Post matches are very extremely difficult and chances in post matches are generally rare.
Try to get into any priliminary position, for the post match, at least have 4 to 5 people calling into the programs and have fax machines ready so that if someone answers positively, you can immediately send your credentials. You have to do all this on a war footing basis
Scores of 90 and 91 are common these days and it has become extremely difficult to get residencies on h1b or j1, while it is a cake walk for those having EAD or GC.
You must also pass step 3 to be considered for h1b, so your chances are only for j1 visa.
Lot of h4, f1, b1 people from all over the world try to get h1 and j1 for residencies, due to retrogression, these numbers have increased because the number of h4s converting EAD or GC has come down because of retrogression and this has made it extremely easy for those having EAd and GC whereas it has caused flooding of applicants seeking h1b or j1.
You must also have passed step 3 as a criteria to be considered for h1b. So your chances are only j1 this year.
A lot of h1b sponsering institutions look for exceptional candidates, but most of them fill their seats through recomendations because the bar they raise seeking exceptional candidates is so high that they finally compromise on candidates having high recomendation.
Most if the residencies are not straight forward, they break all rules ie even in programs where they go for matching, they call the candidate and tell him/her that they will match him/her number 1 or 2 or 10 etc... which is illegal, but they do it expecting the candidate also to match them high, so the matching system is also completely polluted.
Residency programs give a lot of merit to h1b seekers with UK clinical experience, they consider these people as direct fits.
As far as subject is concerned, internal medicine and pshychiatry and pediatrics are options for h1b seekers and I think surgery maybe a difficult option.
Lot of information is found on www.usmleforum.org and you must start contacting your network of friends, alumni etc.... and the journey begins .............
If you have a Green Card or a EAD, sit back and relax, you will get residency with ease.
Concentrate in the New York region, thats where recomendations work out best for h1b seekers
Good luck

Hey there,
I'm going through all that right now. I went to the Driver's License place last Wednesday and it was a pretty bad experience.
My license expires on 10/6 and my EAD on 11/5. But I already received my new EAD that expires on Nov 2012, so I was hoping that they would give me a new license good until Nov 2012 instead of 11/5/10.
So I hand both EAD cards to the woman behind the counter and she tells me they can't use the newer card because it's doesn't start until 11/5, which is ridiculous... so she tells me that I have to use my current, soon to expire EAD and then they will give me a license valid til 11/5. Then I would have to go and renew again using my new EAD. SO annoying. So she tells me to sit down that they are running my name on the computer. After a while she leaves the counter and tells me some other woman will call my name shortly.
After 20 minutes, this new lady calls my name and I have to go through the whole explanation again, and she ends up telling me that I should wait til 11/5 to renew my license. So I ask her, what am I supposed to do between 10/6 (my license exp date) and 11/5? She tells me she doesn't know, to just wait! I ask her if I"m supposed to be driving ilegally to go to work and she tells me she's not saying that I should drive. At that point I'm very upset and I tell her that there must be someone in that building that would know what to do with my case and she says she's the manager!!! Then she says that if she enters my new EAD on the System, that it would be rejected and that I would have to wait 30 days to try to reapply (???). So I told her to run my current EAD instead and she told me the system couldn't validate it either (ARGH!). Obviously, she wouldnt know (or tell me) why neither EAD cards would verify on the computer and gave me a SAVE paper telling me to come back and check again in a week.
So in a couple of days I'll be going back and see how it all continues.
VERY FRUSTRATING.
Sorry for the long post.
fixxer,
Did you call DMV? Did they give you any updates reg. SAVE verification of your EAD?
I'm going through all that right now. I went to the Driver's License place last Wednesday and it was a pretty bad experience.
My license expires on 10/6 and my EAD on 11/5. But I already received my new EAD that expires on Nov 2012, so I was hoping that they would give me a new license good until Nov 2012 instead of 11/5/10.

step n.Sign into law?
Is it the second stage in the process for the bill to become a law?
